Özet
6502 sayılı TKHK ile; tüketici işlemleri ve tüketiciye yönelik uygulamalardan doğan uyuşmazlıkların çözümünde, belirlenen parasal sınırın altındaki uyuşmazlıklarda tüketici hakem heyetlerine başvurulmasının zorunlu olması ve tüketici hakem heyetleri kararlarının, İcra ve İflâs Kanununun ilamların yerine getirilmesi hakkındaki hükümlerine göre yerine getirilmesi düzenlenmiştir. Sürekli artış gösteren tüketici işlemlerinden doğan uyuşmazlıklara az masraflı, kolay, hızlı ve etkin çözüm bulunması ve yargı üzerindeki yükün hafifletilmesi amaçlanmıştır. Tüketicilerin belirlenen parasal sınırın altındaki uyuşmazlıklar için tüketici mahkemelerine başvuramaması ve itiraz edilmeyen tüketici hakem heyeti kararlarının kesin hale gelmesi, tüketici hakem heyetleri kararlarının denetimini ve bu kararlara karşı itiraz usulünü daha önemli bir hale getirmiştir. Çalışmamızın birinci bölümünde tüketici hakem heyetleri kararlarına ait özellikler ile tüketici hakem heyetlerinin verebileceği kararlar ve bu kararların hukuki niteliği işlenmiştir. İkinci bölümde tüketici hakem heyetleri kararlarına itirazın hukuki niteliği, geçerli bir itirazın şartları ile görevli ve yetkili mahkemede itirazın ele alınması ve itirazın etkisi incelenmiştir. Üçüncü bölümde itiraz üzerine tüketici mahkemesinin verebileceği kararlar ve mahkeme kararının niteliği ile bu karara karşı başvurulabilecek hukuki yollara yer verilmiştir.

With the TKHK numbered 6502; It is regulated that in the resolution of disputes arising from consumer transactions and consumer-oriented practices, it is obligatory to apply to consumer arbitration committees in disputes below the determined monetary limit and that the decisions of consumer arbitration committees are fulfilled in accordance with the provisions of the Execution and Bankruptcy Law on the execution of writs. It is aimed to find low-cost, easy, fast and effective solutions to disputes arising from consumer transactions that continue to increase and to alleviate the burden on the judiciary. The fact that consumers cannot apply to consumer courts for disputes below the determined monetary limit and that the decisions of the consumer arbitration committees that are not contested become final, have made the supervision of the decisions of the consumer arbitration committees and the objection procedure against these decisions more important. In the first part of our study, the features of the consumer arbitration committees' decisions, the decisions that consumer arbitration committees can make and the legal nature of consumer arbitration committees decisions are discussed. In the second part, the legal nature of the objection to the decisions of the consumer arbitration committees, the conditions of a valid objection, the handling of the objection in the competent court and the effect of the objection on the decisions of the consumer arbitration committees are examined. In the third part, the decisions that can be made by the consumer court upon objection, the nature of the court decisions and the legal remedies can be applied against this decision are included.
