Özet

Geniş anlamda kamu harcamaları, toplumsal ihtiyaçların karşılanması için kamu ve özel sektör tarafından sunulan sosyal faydası olan mal ve hizmetler için ödenen bedeller olarak tanımlanabilmektedir. Ancak tüm topluma yönelik olarak, piyasada alım satıma konu edilmeyen, faydasından kimsenin dışlanamadığı ve herkes tarafından aynı anda tüketime konu olabilen mal ve hizmetler ise tam kamusal mal ve hizmet sınıflandırılmasında olup, sunumu sadece kamu kurum ve kuruluşları tarafından gerçekleştirilebilmektedir. Çalışmamızın odak noktası olan adalet harcamaları, bu konudaki örneklerden biridir. Adalet hizmetinin sağlıklı bir şekilde yürütülebilmesi, mahkemelerin iş yükünün hafifletilmesi, daha etkin ve verimli hizmetin sunulabilmesi için geliştirilen alternatif çözüm yollarının uygulama sonuçları çalışmamızın odak noktasını oluşturmaktadır. Sanık ile Müşteki arasında meydana gelen uyuşmazlığın geleneksel yargılama yoluyla değil de“Onarıcı Adalet”olarak nitelendirilen uzlaştırma müessesesi bağlamında sağlanması tarafların mahkeme sürecindeki katlanacakları yargılama giderlerinden kaçınmalarını sağlayacaktır. Bununla birlikte tarafların uzlaşmış olmaları halinde daha az bir külfet ile yüksek maddi tazminat ya da hapis cezasından kurtulabileceği örnekler ile çalışmamızda desteklenmiştir.

Public spending, in a broader sense, refers to the costs paid for the socially beneficial and desirable goods and services carried out by public and private sector institutions in order to meet the needs of society. In contrast, the goods and services which are provided for the entire population, not amenable to the market conditions, not excludable individuals and beneficial for the whole society can be defined as pure public goods and services, and therefore they can only be produced by public authorities and institutions. The main theme of this study, spending in justice services, poses a valuable example in this vein. Therefore, the focal point of the study is donated with special attention to the smooth provision of justice service, alleviating the workload of courts, producing alternative ways and means as well as more efficient and effective methods in delivering justice services. The dispute between defendant and complainant would be solved not through traditional justice mechanisms but the process that is become known as 'Restorative Justice' help reduce the financial costs of judicial procedures by promoting the mediation between the two sides. In addition, the study would make use of the examples supporting the view that reconciliatory mechanism facilitates the judicial processes through reducing the trial costs, and avoiding prison sentences and higher indemnity charges.
