This thesis explains the procedural obligation to investigate deaths under Article 2 of the European Convention on Human Rights, thorough six effective principles highlighted in the case of Jordan v the United Kingdom.The thesis connects Article 1 and 2 of the ECHR which requires the State to conduct an effective investigation into alleged violations of the right to life in all cases of unlawful deaths, even if state agents are not involved and in the cases in which States have a negligence. It further explains the nature and trigger of investigations by the Court's case-law.The thesis demonstrates the legal framework and connects it with the Court case law and explains the standards of an effective investigation. To assess the obligation to investigate deaths and apply the six conditions into each case, this thesis considers the articles of the ECHR as well as international jurisprudence and the European Court of Human Right's case-law and deals with the solution when death has occurred by an individual or state agent. The framework as established will assess the effective investigations as follows: independence, impartiality, adequacy, promptness, transparency, family participation and the cooperation between states. By those conditions, we aim to highlight a better understanding of conducting an effective investigation and, as a prosecutor, applying those rules and case-law into our cases to refrain from further violation of the Convention and illuminating each case in accordance with the law.
