Özet
Bu çalışma fikri mülkiyet haklarına -özellikle patent, telif, marka hakları ve ticari sır- ilişkin korumanın savunma sanayiinin gelişimindeki ve bağımsızlaşmasındaki fonksiyonunu analiz etmektedir. Çalışma, iyi yapılandırılmış bir fikri mülkiyet koruması politikasının çift kullanım teknolojileri pazarında teknolojik bilgi difüzyonunu ve çeşitliliğin artmasını neden ve nasıl teşvik ettiğini ve sivil-askeri teknoloji entegrasyonunu nasıl kolaylaştırdığını göstermektedir. Devletlerin, verimli ve uygun fikri mülkiyet koruması politikaları oluşturmak suretiyle milli güvenlik endişelerinin teknolojik gelişmeyi engellemesinin önüne geçmesi gerektiği savunulmaktadır. Devletlerin, ulusal ve uluslararası piyasadaki üstün teknolojilere ulaşabildiği ve aynı zamanda arzu edilen teknolojilerin kazanımı için yabancı savunma teknolojisi tekellerine muhtaç olmadığı bir savunma ekosistemi oluşturulmasındaki hedef, ancak fikri mülkiyet haklarının ticarileştirilmesi ile sağlanabilecektir. Bu doğrultuda, çalışmanın ilk bölümünde, uluslararası anlaşmalar kapsamında, savunma sanayii teknoloji kazanımı ile ilgili olan fikri mülkiyet haklarına genel bir bakış sunulmaktadır. İkinci bölümde savunma sanayiinin özellikleri ayrıntılı olarak açıklanmakta ve fikri mülkiyet haklarının korunmasının savunma sanayilerindeki teknolojik gelişme için neden önemli olduğu açıklanmaktadır. Son olarak, üçüncü bölümde, devletlerin teknoloji kazanımı sözleşmeleri kapsamındaki fikri mülkiyet hakkı yönetimi anlatılmış ve ABD, İngiltere ve Türkiye'nin savunma sanayii ile ilgili fikri mülkiyet hakkı politikaları ve yasaları saptanmıştır.

This study analyses the function of intellectual property rights protection -particularly the protection of patents, copyrights, trademarks and tradesecrests-, for the development and independency of defense industries. The study illustrates why and how a well-structured IPRs policy promotes diffusion of technological information and diversity in the dual use technology market and facilitates civil-military technology integration. It is argued that governments should prevent the national security concerns to interfere with the technological advancement by generating convenient IPRs policies. The objective of building a defense ecosystem where the government can access state of art technologies in the domestic and international market meanwhile is not destitute for importation from foreign defense monopolies for the acquisition of desired technologies will only be fully achieved through commercialization of IPRs. In this respect, the first chapter of the study provides an overview of IPRs relevant to the defense industry technology acquisition transactions in the consideration of international agreements. The second chapter details the characteristics of defense industry and explains why the IPRs protection matters for the technological development in the defense industry. Lastly, the third chapter illustrates the IPRs management under governments technology acquisition contracts and pinpoints the IPRs policies and laws of U.S., UK and Turkey in regards to defense industry.
