Özet
Uyuşturucu veya uyarıcı madde ticareti suçları, küresel çapta karşılaşılan en büyük sorunlardan birisini oluşturmaktadır. Her geçen gün artan kullanım talebini karşılamaya yönelik oluşan uyuşturucu ve uyarıcı madde arzı, illegal bir ticareti ortaya çıkarmıştır. Zararlı etkileri kadar yararlı etkileri de bulunan uyuşturucu maddelerin, bu yararlı etkileri göz önünde bulundurularak tamamen yasaklanması yoluna gidilmemiştir. Nitekim uyuşturucu, uyarıcı ve psikotrop maddeler, tıp ve ilaç biliminde geniş bir kullanım alanına sahiptir. Bu faydalı kullanım amaçları doğrultusunda devletler, belirli ruhsatlar dahilinde bu maddelerin imalinden, satışına ve kullanımına kadar ki tüm eylemleri kontrol altına almaya yönelik sözleşmeler imzalamışlar ve bu sözleşmelere ne derece uygun hareket edildiğini denetleyecek birçok uluslararası kuruluşlar kurmuşlardır. Türkiye'nin kendi egemenlik sahasındaki uyuşturucu madde suçlarıyla mücadelesinin yasal alt yapısını ise 2313 sayılı Uyuşturucu Maddelerin Murakabesi Hakkında Kanun, 3298 sayılı Uyuşturucu Maddelerle İlgili Kanun ve Türk Ceza Kanunu'nun ise 188 ve devamı maddeleri oluşturmaktadır. Tez çalışmamızın kapsamını Türk Ceza Kanunu'nun 188. maddesinin üçüncü fıkrasında düzenlenen ruhsatsız veya ruhsata aykırı olarak ülke içinde uyuşturucu veya uyarıcı madde satmak, satışa arz etmek, sevk etmek, nakletmek, satın almak, kabul etmek, başkalarına vermek, depolamak veya bulundurmak seçimlik hareketli suçları oluşturmaktadır. Bunun yanında uyuşturucu veya uyarıcı maddelerin ve buna ilişkin kavramların tanımlar, nitelikli haller, etkin pişmanlık ve yargılamaya ilişkin konular oluşturmaktadır.

Drug or stimulant trading crimes are one of the biggest problems encountered globally. The supply of drugs and stimulants, which are increasing day by day and aimed at meeting the demand for use, has led to the emergence of illegal trade. Drugs, which have beneficial effects as well as harmful effects, have not been completely banned by taking these beneficial effects into consideration. As a matter of fact, drugs, stimulants, and psychotropic substances have a wide range of use in medicine and pharmaceutical science. In line with these beneficial uses, states have signed contracts to control all actions from the production, sale, and use of these substances within certain licenses. However, many international organizations have been established to inspect whether these conventions are complied with. The legal infrastructure of Turkey's, which fight with the drug-related crimes in their sovereignty, consists of the Law on Inspection of Drugs No. 2313, Law No. 3298 on Narcotic Drugs, and the 188 and follow-on articles of the Turkish Criminal Code. The scope of our thesis; Selling, offering for sale, consigning, transferring, purchasing, accepting, giving to others, storing or keeping drugs or stimulants in the country without a license or contrary to the license regulated in 3 paragraphs of 188 Article of the Turkish Criminal Code, are crimes with an optional action (In the definition of the crime, it is the crimes where more than one action is shown as an option and that doing any of them is sufficient for the crime to occur). In addition, the thesis includes the definitions of drug or stimulant substances and related concepts, qualified cases, effective repentance, and issues related to the judgment.
