As a signatory of the Geneva Convention of 1951 and the 1989 UN Convention on the Rights of the Child (CRC), Turkey and Hungary are bound to protect and assist unaccompanied minor refugees. Nonetheless, ensuring the 'best interests' of unaccompanied minors (“UAMs”) in matters ranging from accommodation, access to health services and education to legal assistance is made difficult by discrepancies between laws and practices in both countries. This empirical study examines non-alignments among the Police and social institutions regarding the reception of unaccompanied minors (UAMs) and the determination of their age, which can result in exploitation of care and the psycho-social deterioration of the children. Desperate and fearful of being sent back to the zones they escaped from, unaccompanied minors are detained in child-care facilities or live under terrible work conditions in illegal work places. Referring to improvements for detention procedures in the recent years, the research mainly focuses on the current problems that migrant children travelling without parents or relatives face in Turkey and Hungary: bureaucratic obstacles to access to services, a foreign identification number, guardianship and psycho- social support. Based on the reports of national authorities and international organisations, it concludes with the recommendations for improvements in the protection of these vulnerable migrants.
