ÖZET YÜKSEK LİSANS TEZİ TÜKETİCİNİN KORUNMASI VE MÜLKİ İDARE Ahmet Şahin ÖZCAN Danışman : Prof. Dr. Recai ÇINAR 1997, Sayfa: 144 Jüri Prof. Dr. Recai ÇINAR Geniş anlamda tüketici, hayatını ve varlığını devam ettirmek için bir mal, hizmet veya benzeri herhangi bir şeye ihtiyacı olan ve bunları kullanan her varlığa denir. Tüketicinin korunması, bir toplumda tüketicilerin refahını artırmak için yapılan örgütlenmiş çabalardır veya tüketicinin haklarının sağlanması, korunması ve pazardaki güçlerinin arttırılması için işletmeler, hükümet, devlet yetkilileri ve bağımsız örgütlerce gösterilen çabaların toplamıdır. Bu açıdan, tüketicinin korunması için mülki idareye önemli görevler düşmektedir. Ülkemizde, mülki idareye, bu görevleri yapabilmeleri için etkili ve uygun yetkiler verilmesi gerektiği anlaşılmaktadır. Tüketicilik ve tüketicinin korunması artık önemli bir olgu haline geldiği ortaya çıkmaktadır. Tüketici sorunlarının çözümü ve tüketici haklarının sağlanması, tüketiciyi korumanın esaslarını oluşturmaktadır. Bu yüksek lisans tezinde, teorik çerçeveden hareketle, tüketicilerin korunmasının genel olarak durumları incelenmiş ve ülkemizde bu konuda özellikle mülki idarenin durumları tespit edilmeye çalışılmıştır. Araştırmanın sonucuna göre; tüketicinin korunmasında malların satıldığı yerler, ön plana çıkmaktadır. Ayrıca Sarayönü ilçesindeki tüketicilerin çoğunluğu alış verişte TSE damgasına dikkat etmekte ve bu çoğunluk T.S.E., mülki idare, bağımsız tüketici örgütleri, belediye ve Sanayi ve Ticaret Bakanlığının ilgili kurumları tarafından işbirliği ile tüketicilerin korunmasını tercih etmektedir. Ayrıca aynı çoğunluk alış verişte en çok kaliteyi tercih etmektedir. Yine bu çoğunluk tüketicinin korunması hakkındaki kanun yürürlüğe girdikten sonra ürünler ve satış işlemlerinin az da olsa düzeldiğini belirtmektedir.Ayrıca bu çalışma sonucunda tüketicilerin korunması ^hakkındaki mevzuat ve kurumların yetersiz bulunduğu tespit edilmiştir. Prf.Dr.Recaî ÇINAR The consumer, in extensive meaning, is somebady who needs something like goods, service or etcetera each onething and users of this facilities to maintain his or her life. The protection of consumer are organized efforts to increase the comfort of the consumers or total of showed efforts by companies, competents of administration, state and independent organizations to keep and protection of the rishts of consumer and to increase their force in the market. Because of this point of view, important functions fall to civil government lot for protection of consumer. It is understood that civil governments should be given effective and reasonable competences in order to do this functions efficiently in our country. Consumership and the protection of consumers are becoming very important cases any more. Solving the problems of consumers and keeping rights of consumer are the fundamental principles of the protection of the consumer. In this mastar thesis, moving from a theoretical framework, the situations of the protection of consumers have been tried in general and in our country, in this matter, situations of civil government have been studied to determine specially. According to the result of research, shops have been coming to the front on protection of consumer. According to the result of research, shops have been coming to the front on protection of consumer. In addition, majority of the consumer in Sarayönü district has been paying attention mark of TSE in shopping and this majority has been giving preference to protection of consumers with cooperation by T.S.E., civil government, independent consumer organizations, municipality and the releted councils of Industry And Trade Ministry. Also same majority has been givjhg preference to most the quality in shopping. Again, this majority, has been obşervihg IIIthat produces and the operations of sales have been improving although few after the law that about the protection of consumer became effective. Also, it has been determined that the body of current law and councils those about protection of consumer were found insufficiently. IV
