Özet
SUMMARY The standardization and quality policy of European Union has a considerably different structure than the present system in Turkey. In order to protect the Turkish exports to European Union which make up the 50 % of our total exports, short and medium range measures should be specified and put into operation as soon as possible. The aim of this thesis is to clarify the concepts of technical barrier and standardization as well as to evaluate the European Union technical regulations also to abolish the trade barriers, to specify the Turkish technical regulations and the necessary studies for Turkish technical regulations to comply with European Union technical regulations. The European Union keeps on working more systematically on the abolition of all technical barriers which restrict the free movement of goods. The European Union bases its standardization and quality policy on the“ Council Resolution on a New Approach to Technical Harmonization and Standards ”. In addition,“Council Resolution on a Global Approach to Conformity Assesment ”and“ Council Decision the Modules for the Various Phases of the Conformity Assesment Procedures and the Rules for the Affixing and the Use of the CE Conformity Marking which are Intended to be Used in the Technical Harmonization Directives ”were adopted and the infrastructure needed to implement these resolutions and decision was established. GATT Uruguay Round/ Agreement on Technical Barriers to Trade which was signed in 1994, was adopted with the view that international standards and comformity assesment procedures would help to improve the production quality and efficiency and facilitate the international trade. The main objectives of this Agreement members shall ensure that technical regulations are not prepared, adopted or applied with a view to 137açısı ile konu ile ilgili mevzuat uyum çalışmaları GATT'a uyum sağlamak amacıyla bir araç olarak düşünülebilir. Türkiye'nin tam üyelikte ısrar etme politikasının değişmeyeceği düşünüldüğünde ve Avrupa Birliği 'ne tam üyelik hedefinden ödün verilmediği sürece birlik sistemine uyum zorunludur. Bu zorunluluk, hem yasal zemini hem de bu yasal zemine dayanacak sistemin alt yapısının oluşturulmasını gerektirmektedir. AB içindeki teknik sisteme ne kadar çabuk uyum sağlarsak o kadar kazançlı oluruz. Bu uyum Türk sanayi ürünlerinin sadece birlik piyasasında değil uluslararası piyasalardaki rekabet şansım arttırmak bakımından önemlidir. 136

For this purpose, technical regulations shall not be more trade-restrictive than necessary to fulfill a legitimate objective, taking account of the risk non fulfillment would create. Such legitimate objectives are international security requirements, the prevention deceptive practives, protection of human health or safety, animal or plant life or health, or the enviroment. In 1995, the GATT Agreement has been signed and accepted by the Turkish Parliament. Turkish technical regulations have to comply with GATT regulations. The preparation of Turkey to adopt to European Union regulation will also serve as an adoptation to GATT regulations. Unless the objective being a full member of the European Union is given up, the adoptation of the Turkish Standardization System to the European Union's is unavoidable. This adoptation also requires the establishment of the infrastructure upon which the legal base of the system will be built. 138
