SUMMARY Turkey-EC official relationship derives from the 1963 Ankara Agreement.The Additional Protocol lays down the terms and conditions of the transitional stage, and foresees a customs union between the parties. The principles envisaged by the Agreement and the Protocol are implemented through the Association Council Decisions. Hence the criterias guiding the free circulation of goods, the certificates to be used, and briefly the functioning of the system are all determined by the Association Council Decisions. Indeed, the principles of the customs union established on 1 January, 1996 are also laid down by Decision 1/95. Related to customs matters and referring to Community Customs Code and its Implementing Provisions, Article 28 of the said decision envisages the harmonization of Turkish customs legislation. The goal is the uniform application of the provisions having a direct effect on movement of goods within the customs territory of the customs union. Presently, the customs union concept goes far beyond its classical description and also covers the elimination of non-tariff barriers (eg. pyhsical, techinical,. financial barriers) Since, existence of different customs policies and divergent customs legislations do not comply with the proper functioning of the customs union, the studies for legal harmonization have accelerated. Although the basic amendments came into force -just before the establishment of the customs union- by the decree having the force of law No. 564, an amendement to the Turkish Customs Law covering institutional, criminical, financial and structural provisions was required. As a result an interim legislation was established. So called“bridge legislation”, Decision No. 1/96 of the Customs Cooperation Committee laying down the implementing provisions of Decision 1/95 came into force on 1 July, 1996. The provisions applicable to trade among EC-Turkey and third countries have been set out by this arrangement. However, coming into force of the draft law is required for the customs procedures with the economic impact as well as structural changes. With the entry into force of this draft which is pending before the parliament, an important stage of the legal harmonization process will be concluded. Simultaneously, modernization project carried out by the Undersecretariat for Customs aims the efficient control while minimizing the customs formalities. This research points out the legislative amendments carried out or being carried out. And it was concluded that the draft customs law meets the requirements of the customs union and global trade.
