Özet
Eğitim ve öğretim hizmeti, devletin gözetimi ve denetimi altında yapılmaktadır. Özel kurumlar da ancak devletin denetimi ve gözetimi altında eğitim ve öğretim hizmeti verebilmektedirler. 5580 sayılı Özel Öğretim Kurumları Kanunu'nda, bu hizmetin nasıl verileceği ile ilgili esaslara yer verilmiştir. Özel öğretim kurumlarından biri olan özel okullar da bu Kanuna tabidirler. 5580 sayılı Özel Öğretim Kurumları Kanunu'nda, özel okulların nasıl kurulacağı, eğitim personeli olan öğretmenlerle nasıl sözleşme yapılacağı, öğretmenlerin çalışma esasların neler olduğu gibi hükümlere ye verilmiştir. İşçi niteliğine de sahip olan özel okul öğretmenleri aynı zamanda 4857 sayılı İş Kanunu'na da tabidirler. Öğretmenlerin her iki Kanuna da tabi olmaları ise ortaya çıkan sorunların çözümünü zorlaştırmıştır. Bu çalışmada, özel okul öğretmenlerinin iş sözleşmeleri incelenmiş, çalışma esaslarına yer verilmiş ve her iki Kanuna göre Yargıtay kararları ile birlikte değerlendirmeler yapılmıştır.

The education service is provided under the supervision and control of the state. Private institutions are also able to provide education service under the supervision and control of the state. In the Law of Private Education Institutions numbered 5580, the principles of how this service will be provided are described. Private schools that are among the private education institutions are subject to this Law as well. In the Law of Private Education Institutions numbered 5580, provisions such as how will the private schools be established, how contracts will be signed with the teachers who will be the staff of education and what will be the work principles of the teachers, are stated. Private school teachers, who also possess the qualification of a worker, will also be subject to Labor Law numbered 4857. The fact that the teachers are subject to both of the laws has created difficulties in resolution of the problems that arise. In this study, the contracts of private school teachers are examined, the principles of their work described, the conclusion of the contract examined and according to both of the laws, together with the decisions of the Court of Cassation, evaluations are made.
