Özet
Osmanlı Devleti'nin, Tanzimat Devri'ndeki en önemli isimlerinden biri olan Ahmed Cevdet Paşa, bu dönemde devlet, toplum ve hukuk açısından ortaya çıkan ikilemlerin aşılması noktasında önemli bir role sahiptir. Fıkıh tahsili ve siyasi tecrübesi sayesinde, bir yandan Osmanlı birikimini koruyup diğer taraftan dönemin gerektirdiği yenilikleri yapabilmesi büyük ölçüde mümkün olmuştur. Kendisinin öncülüğünde hazırlanan ve Osmanlı Devleti'nde fıkıh alanındaki ilk kanunlaştırma olan“Mecelle-i Ahkâm-ı Adliye”isimli medeni kanun, bu açıdan en mühim misaldir. Cevdet Paşa, Mecelle'yi devletin temel kanunu olarak gördüğünden, Batılı anayasaların etkisiyle hazırlanacak ve devletin temel kanunu olacak Kānûn-ı Esâsî'ye karşı çıkmıştır. Söz konusu hususun ele alındığı ve 'Giriş' kısmının ilk bölüm olduğu bu tez çalışmasının ikinci bölümünde, Ahmed Cevdet Paşa'nın fikri alt yapısını anlayabilmek adına, onun hayatı, eğitimi ve devlet hizmetindeki görevlerine yer verilmiştir. Çalışmanın üçüncü bölümünde, Cevdet Paşa'nın devlet ve hukuk kavramlarına bakışı incelenmiş; bunun yanı sıra hukuka dair düşünceleri noktasında, Von Savigny'nin örf-âdete dayanan tarihsel bakış açısıyla benzer ve farklı yönleri ele alınmıştır. Çalışmanın dördüncü bölümündeyse; Ahmed Cevdet Paşa'nın anayasa kavramına dair düşünceleri ele alınmış; bu noktada, Fransız İhtilali ile ortaya çıkan anayasallaşma hareketindense, İngiltere'deki gibi örf-âdete istinaden zaman içerisinde oluşan yazısız anayasa fikrini daha doğru bulduğuna değinilmiştir. Ayrıca Osmanlı Devleti'ne yazılı anayasa kavramını ilk defa getiren Yeni Osmanlıların bu konudaki düşünceleri kısaca açıklanmış ve meşrutiyet kavramı da dikkate alınarak Cevdet Paşa'nın anayasa görüşüyle karşılaştırılmaya çalışılmıştır.

Ahmed Cevdet Pasha, one of the most significant figures in the Ottoman Empire at the Tanzimat Reform Era, had an important role in terms of clearing the dilemmas arising in this era about state, society and law. Thanks to his education in fiqh and his political experience, he had managed to protect the Ottoman intellectual background as well as to implement the novelties which were required by that era. The ottoman code of civil law“Mecelle-i Ahkâm-ı Adliye”prepared under his leadership which was the first codification in fiqh in Ottoman Empire is the most important example in this regard. Cevdet Pasha regarded Mecelle as the basic law of the state. So, he opposed Kānûn-ı Esâsî which was prepared under the influence of Western constitutions to be the basic law of the state. After 'Introduction' section which is the first chapter of this dissertation, in the second chapter addressing the subject above, Ahmed Cevdet Pasha's life, education and his positions in civil service were mentioned, in order to understand his intellectual background. In the third chapter of the study, Cevdet Pasha's view on concepts of state and law was examined and also similarities and differences between his opinions on law and Von Savigny's historical point of view based on common law were indicated. In the fourth chapter of the study; Ahmed Cevdet Pasha's opinions on the concept of constitution were discussed; at this point, his preference of an uncodified constitution evolving in time based on common law as in Britain over the act of constitutionalization after the French Revolution. Additionally, the relevant opinions of the Young-Ottomans who introduced the concept of a written constitution into the Ottoman Empire were explained briefly and compared to Cevdet Pasha's view of constitution taking the concept of monarchy into consideration.
