Özet
Tez“sivil itaatsizlik”teriminin kavramsal analizi ile ilgili yapılan bir çalışmayı içermektedir. Bu amaçla kavramın tanımlanması ve anlaşılmasında önem arz eden itaat kavramı, itaatsizlik kavramı; kavramın dar, geniş ve baskın tanımı, kavramın temel unsurları, kavramın meşruiyetinin temelleri, sivil kavramının tarihsel gelişimi ve kavramın anlamsal gelişimine, pratik ve teoride, katkısı bulunan düşünürler ele alınmıştır. Demokratik kültüre uygun özel bir siyasi mücadele biçimi olması ve gerçekleşme koşullarını sadece demokratik anayasal rejimlerde, anayasanın meşruluğunu benimsemiş yurttaşların olduğu ortamda bulan bir eylem tarzıdır. Taşıdığı temel unsur ve özelliklerden dolayı eylemin gerçekleşme koşulları ve taşıdığı amaç bakımından isyan, terör ve devrimci eylem tarzlarından tamamen faklı bir özellik taşıyan bir eylemdir. Ayrıca ahlaki meşruluğunu evrensel adalet ilkelerinden alan ve şiddetsiz bir direniş biçimi olarak bilinen bir siyasi terimdir.

The thesis includes a study on the conceptual analysis of the term“civil disobedience”. For this purpose, the concept of obedience which is important in defining and understanding the concept, the concept of disobedience; the narrow, broad and dominant definition of the concept, the basic elements of the concept, the foundations of the legitimacy of the concept, the historical development of the concept of civil and the semantic development of the concept, thinkers who have contributed to the practice and theory. It is a special form of political struggle appropriate to the democratic culture and a mode of action that finds the conditions of realization only in democratic constitutional regimes, in the context of citizens who have adopted the legitimacy of the constitution. Rebellion is an action that is completely different from terrorism and revolutionary modes of action in terms of the realization conditions and purpose of the action due to its basic elements and characteristics. It is also a political term that takes its moral legitimacy from the principles of universal justice and is known as a form of nonviolent resistance.
