Özet
“Ecr ve Damân İctima' Etmez”kâidesi Mecelle'nin ilk yüz küllî kaidesi içinde 86. kâide olarak geçmektedir. İmam Muhammed'in el-Asl isimli eserinden derlenmiştir. Hanefi mezhebinin kâideleri arasında zikredilir. Ücret; icare akdinin rükünlerinden biri ve menfaatin bedelidir. Damân konusu ise fıkhın tüm alanlarında özellikle de borçlar hukuku ve yargılama hukuku alanlarında karşımıza çıkan temel konulardan birisidir. Kâidenin konu muhtevasına bakıldığı zaman mal, menfaat, kabz, fesh gibi birbirleri ile bağlantılı konuları içerdiğini görüyoruz. Kâidenin özünde ve mezheplerin ihtilafının temelinde menfaatin tazmin meselesi yer almaktadır. Mezhepler bu kâide üzerinde ihtilaf etmişler, Hanefi mezhebi bir tarafta diğer mezhepler bir tarafta yer almıştır. Bu ihtilafın sebepleri birden fazladır. Göze çarpan ilk ve belki de en önemli ayrım kanaatimizce kavramlara yüklenen tanım farklılıklarıdır. Hanefi nazariyesinde kâide hakkında verilen önceki içtihatlardan zamanın ve şartların gelişimine paralel olarak farklı içtihatlar geliştirilmiştir.

“Wage and responsibility cannot be combined.”Is the 86. rule of the first hundred laws of Mecelle. It was compiled from İmam Muhammed's book 'el-Asl'. This rule is accepted by the members of the Hanefi sect. Wage is a part of the“icare”. That means it's the provision for the benefit that was granted. Responsibility or commitment is a topic we're encountering in every aspect of Islamic law. Especially when we're looking at the rules for debt or for jurisdiction. If we look at the content of this topic we'll see that it contains a lot of connected subjects like this goods, favors, to accept something and termination. In the essence of this law and the controversy between the sects we'll find the matter of compensation. The different sects disagree over this rule. Hanefi's on one side and all the other sects on the other. There are more than one reason for this dispute. The first thing to catch the attention and maybe the most important reason are the different definitions for the same descriptions. Members of the Hanefi sect developed new interpretations in parallel with the changing circumstances for the 86. Rule of the Mecelle.
