Özet
Bu çalışmanın temelini meşru savunmanın hukuki esası ve meşru savunmanın savunmaya ilişkin şartları olarak gereklilik ve orantılılık unsurları oluşturmaktadır. Ayrıca gereklilik ve orantılılık bağlamında hata ve sınırın aşılması halleri de bu çalışmanın bir parçasını teşkil etmektedir. Bu bağlamda çalışmanın birinci bölümünde meşru savunma kavramı, tarihsel gelişimi, hukuki esası ve hukuki niteliği; ikinci bölümde savunmanın temel şartı olarak gereklilik ve üçüncü bölümde ise savunmanın sınırlandırıcı fonksiyonu olarak orantılılık ile hata ve sınırın aşılması halleri detaylıca ele alınmıştır.

The basement of this study is the legal basement of self defence and the elements of necessity and proportionality that are the conditions in relation to defence of self defence. Also the conditions of mistake and exceeding the limit within the context of necessity and proportionality are another parts of this study. In this context in the first chapter; the concept of self defence, its historical development, legal basement and legal character; in the second chapter; the necessity as a basic condition of defence and in the third chapter; the proportionality as the limiting function of the defence and the conditions of mistake and exceeding the limit were examined in detail.
