Özet
Günümüzde devletler, ülkelerinin iç emniyet ve asayişini polisler aracılığıyla sağlamaktadır. Polisler, belirli yerlerde ve noktalarda nöbet tutarak ya da devriye görevini ifa ederek ülkenin iç asayişini sağlamakta, bu durumda önleyici polislik ya da proaktif polislik olarak tanımlanmaktadır. Buradan hareketle Osmanlı Devletinde de günümüzdeki gibi isimlendirilmemiş olsa da herhangi bir biçimde önleyici ya da proaktif polislik var mı yok mu sorusunu cevaplamak amacıyla bu çalışma yapılmıştır. Çalışma, özellikle II. Meşrutiyet sonrası Osmanlı Devleti'nin siyasi, ekonomik ve toplumsal olarak büyük değişimlerin yaşandığı 1908-1912 tarihleri arasını kapsamaktadır. Özellikle bu tarihler arasında önleyici polisliğin tespiti amacıyla 1908-1912 yıllarından önce çıkarılmış ve bahse konu yıllar arasında da yürürlükte kalmış olan mevzuat ile söz konusu tarihler arasında yeni olarak yayımlanmış kanun, nizamname, yönetmelik ve talimatlar incelenmiştir. Bu incelemelerde polisin anayasası niteliğinde olan ve 1907 senesinde yürürlüğe giren Polis Nizamnamesi'nde yer alan polisin üç ana görevinin ikisinin önleyici polislik ile ilgili olduğu tespit edilmiştir. Bu nizamnamenin dışında yer alan ve çalışmada ifade edilen diğer mevzuatlarında polise önleyici görev yüklediği ortaya çıkarılmıştır. Bu tespitten sonra tespiti destekleyici mahiyette Başbakanlık Osmanlı Arşivi'nde bulunan Osmanlı Devleti'nin resmi kayıtları arasında yer alan konu ile alakalı belgelerden en önemlileri seçilerek tez çalışmasına eklenmiştir. En son olarak da mezkur tarihler arasında Osmanlı yazılı basını taranarak tez çalışması ile ilgili haber ve bilgilerle çalışmaya zenginlik katılmaya çalışılmıştır. Tüm bu çalışmalardan, 1908-1912 yılları arasında Osmanlı Devleti'nde günümüzdeki gibi isimlendirilmemiş olsa da önleyici polisliğin var olduğu ve bu polisliğin, ülkenin iç emniyet ve asayişinin sağlanmasında olumlu katkısının olduğu ortaya konulmuştur.

At the present time, goverments provide domestic safety and public order of their countries by the police. The police provide domestic safety of the country by being on duty or performing patrol duty at specific places and dots. This situation is defined as preventive or proactive policing. So, this study was done with the aim of answering whether or not there is preventive or proactive policing in any form even though it wasn't also entitled in the ottoman state like nowadays. The study contains interval of 1908-1912 that big changes was actualized as political, economic and social in the Ottoman State especially after the second constitutionalism. Especially between these dates, the law, the charter, the regulations and precepts that were published newly between aforesaid years were examined with the legislation that were enacted with the aim of detection of the preventive policing before 1908-1912 and remained in force between years mentioned. It was made firm that two of three main duties of the police placed in the regulation of police effectuated in 1907 and had characteristics of constitution for the police were related to preventive policing. The other legislations that placed out of this regulation and was expressed in the study also revealed to give a preventive mission to police. They were added to thesis work by choosing the most important beings of the documents related to subject placed between formal recordings of the Ottoman State and the Ottoman archives of the prime ministry for supporting determination after this determination. Lastly, the print media of the Ottoman State between the aforementioned dates was reviewed and news and information related to the topic of this thesis were used with the aim of enriching this study. All of these efforts revealed that preventive policing existed in the Ottoman State between 1908 and 1912, although it was not called the same as it is today and it positively contributed to domestic safety and public order.
