Özet
İslâm Hukuku, yürürlükte olan bir hukuk sistemidir. Ve“malın”korunması bahsi de İslam hukukun önemli bir alanını teşkil eder. İslam'ın beş temel gayesinden biri olan“Mal”kavramının korunması ise bizzat Hz. Peygamber'in kendisine vahiy gelmesinden evveline dayanır. Hatta ve hatta ilk insan ve ilk Peygamber olan Hz. Âdem zamanından beri“Mal”kavramı İslam açısından çok mühim bir yere sahip olduğu bedihidir. İslâm Hukukunda bizzat ayetlerin sarih ifadeleri ile ve bazı hususlarda da sahih sünnet ile genel olarak fıkıh eserlerinin hadler ve ukubat bölümünde değerlendirilmiştir. Özellikle son dönemlerde ise İslam hukukunda mal ve eşya konulu pek çok risaleler ve müstakil eserler kaleme alınmıştır. Bu kısa tarihi seyre baktığımızda bile mal-eşya kavramının insanın hayatında çok önemli bir yeri teşkil ettiği kendisini göstermektedir. İslam Hukukunda“Malın”Korunmasına Yönelik hükümlerinin tatbiki de günümüzde hayli bir önemli hale gelmiştir.

Islamic Law is a kind of law system in force.The protection of property constitutes an important area of Islamic Law. The protection of property which is one of the five basic foundations of Islam rests upon previous years of the Prophet's revelation. Even, Since the first man and the first Prophet Hz. Adam's time, it is obvious that the concept of property has a very important place in terms of Islam. In Islamic Law, the subject of property generally is discussed in the editions of provisions by expressions of the verses and in some respects by the Prophet Sunnah. Especially in the recent periods, many articles and works on the subject of asset and property in Islamic Law have been discussed. If we even look at this short brief of history, it clearly shows itself that the concept of property-asset is a very important place in human life. At the present time, the application of the provisions for the protection of property in Islamic law has become very important
