Özet
Zararlandırıcı olay sebebiyle meydana gelen ölümlerde, ölenin desteğinden yoksun kalan kişilerce, sorumlulardan talep edilebilecek destekten yoksun kalma tazminatı, sorumluluk hukukunda ayrı bir öneme sahiptir. Tazminata esas olan zarar, yansıma yoluyla uğranılan bir zarar türü olması nedeniyle Türk hukuk sisteminde istisnai bir düzenlemeye dayanmaktadır. Destek, başkasının geçimini kısmen veya tamamen, sürekli ve düzenli olarak sağlayan veya ona ileride bakması kuvvetle muhtemel olan kişiyi ifade etmektedir. Türk Hukuku'nda destekliğin yalnızca parasal yardım olarak değil, yardım ve hizmette bulunmak suretiyle de gerçekleşebileceği kabul edilmektedir. Çalışmayan ve geliri bulunmayan kişilerin vefat etmesi durumunda da, yakınlarının destekten yoksun kalma zararına uğrayacağı kabul edilmekle birlikte, zararın hangi gerekçelerle doğduğu, yardım ve hizmet ediminin kapsamının ne olduğu, yardım ve hizmet ediminin ekonomik karşılığının nasıl belirlenmesi gerektiği, zarardan indirilecek indirim sebeplerinde nelerin göz önünde bulundurulacağı, desteklik ilişkisinin ve zararın nasıl ispat edileceği konusunda görüş birliğine varılmaya ve ortak bir uygulama geliştirilmeye çalışılmaktadır.

Compensation for the loss of support, which can be claimed by the people who lose the support of the deceased from a liable party, has a very significant importance in liability law in case of a death by a harmful event. Since this type of damage is a consequential damage that is not inflicted by the peril itself but suffered as a consequence of the direct loss, it has an exceptional regulation in Turkish Legal System. Support refers to a person who completely or partially is providing someone else's livelihood in a constant and regular way and who will most likely to continue to do so in the future. It is accepted in Turkish Law that support is not only financial but also may be providing help and services. Therefore, it is also accepted that, the relatives will suffer the loss of support in the case of death of those who are not working and those who have no income. However, in that case, scholars are trying to reach a consensus and develop a common practice on determining the ways to prove the reason for the loss, the scope of the help and services, damages, and support relationship; determining the monetary value of the help and services and determining the causes to be considered when calculating the monetary value of the support.
