Özet
Günümüzde resmi olarak Irak Kürdistan Bölgesi olarak adlandırılan bölge, 1921 yılında kurulan Irak Devleti sınırları içerisinde yaşayan Kürtlerin yoğun olarak bulunduğu alanı ifade etmektedir. Ortadoğunun kadim halklarından biri olan Kürtler, kendilerine has dilleri, kültürleri ve tarihsel kökleriyle Irak Devletini oluşturan diğer halklardan farklılaşarak özgünlüklerini korumuştur. Bu özgünlük kimi zaman bağımsızlık noktasına varacak ulusal taleplere de yol açmıştır. Irak Devletinin kurulduğu ilk günden bu yana Kürtlerin mücadelesini verdiği özerk yönetim ve statü talepleri yaklaşık yüzyıllık bir süreçten sonra bugün hukuki bir çerçeveye kavuşmuş görünmektedir. Ancak, bir yandan Irak Devletinin yaşadığı siyasal ve anayasal sorunlar, diğer yandan Kürtlerin bağımsızlık referandumuyla ortaya koyduğu talepler, Irak'ta Kürtlerin statüsüne dair tartışmaların bitmediğini göstermektedir. Bu tartışmaları ve olası gelişmeleri anlamak için Irak Kürdistan Bölgesinin hukuki statüsünü ve yönetim yapısını anlamak önemlidir. Bu tez çalışmasında, öncelikle günümüzde Irak Federal Cumhuriyeti içerisinde federe bir yapı olarak ortaya çıkan Irak Kürdistan Bölgesine varan süreçte Irak Kürtlerinin özyönetimine ilişkin yaşanan gelişmeler incelenecektir. Bu tarihsel süreç sonucunda Bölgede ortaya çıkan yönetim sisteminin özelliklerinin ve Bölge Başkanının yürütme ve yasamaya ilişkin yetkilerinin incelenmesi bu çalışmanın ana eksenini oluşturacaktır.

Today, the autonomous region known as Iraq Kurdistan Regional Government refers to the area where the Kurds live densely in the Republic of Iraq-founded in 1921. The Kurds, one of the indigenous peoples in the Middle East, have maintained their ethnic identity by preserving their language, culture, and historical roots and by differentiating themselves from the other minority groupsformingthe state of Iraq. This differentiation sometimeseven gave rise to declare independence from the state. It seems that, starting from the establishment of Iraq, almost a hundred year old Kurdish struggle for autonomy and legal status now paved the way for a legal framework. However, the political and constitutional problems faced by the Iraqi State on the one hand, and the clamors of Kurds after the referendum for independence on the other, show that the dispute on the status of the Kurds in Iraq is not over yet. It is important to understand the legal status and the governing structure of the Iraqi Kurdistan in order to understand these debates and to anticipate the future developments in the region. In the light of these, the first aim of this thesis is to analyze the processes and developments related to the self-government of Iraqi Kurds, once being a federated structure within the Federal Republic of Iraq and now being Kurdistan Regional Government .The main aim of this proposal is to analyze the key features of the governing system emerging upon these historical developments and the executive and legislative powers of the President of the Region.
