Özet
Alt yapısı dağılmış Irak ekonomisinin, yatırımcıları çekmek için yapılandırılması ve bu doğrultuda yönetilmesi gerektiği bilinen bir durumdur. Bu bilimsel tezde, ülkenin içinde bulunduğu duruma ilişkin bilimsel araştırmalar ve büyüme çağında olan ülkelerin deneyimlerinden ilham alınarak, 2006 yılında çıkarılan 13 Sayılı Yatırım Kanunu incelenmiştir. Büyümekte olan ülkelere yatırımcı çekmenin kolay olmadığı bilinmeyen bir konu değildir. Çünkü yatırımcı ve özellikle yabancı yatırımcı, yatırım kararını, ülkede bulunan tahmini kâr ile rastlayacağı tehlike dengesini göz önünde bulundurarak yapar. Denge faktörü, yatırımcıya sunulan güven ve riskler; ülkede bulunan güvenlik, siyasi ve ekonomik istikrarın düzeyi, güvencelerin ve bunlara dair atılacak olan somut adımların sağlanması için açık yasaların bulunmasına ve uygulanmasına bağlıdır. Dolayısıyla, bu tez de Irak Yatırım Kanununun sağladığı teşvik ve güvencelere ışık tutacağız. Güvenceler ve bu güvencelerin getirdiği özelliklerin amacı, uygun yatırım ortamı ve ekonomik getirileri bir arada toplayıp; yatırımcılara güven anahtarı sunarak, onları bu alanlara çekmek, gelecekte devlet tarafından temel yatırım kurallarını bitirecek veya aleyhe duruma getirecek yasa ve idari işlemlere karşı yatırımcıları korumayı sağlamaktadır. Güvence, yatırımcıya uyguladığı yatırım projesinin meyvesini alma hakkını sağlar, böylece gelirini artırmak amacıyla uyguladığı projenin geliştirilmesine yönelik daha fazla çaba sarf eder ve harcama yapar. İş bu durum, milli ekonominin kalkınması ve desteklenmesi açısından ülkeye pozitif etkiler sağlamaktadır.

Nowadays, in general, Iraq's intention is to attract foreign investment for the restructuring of the economic structure of the country which its infrastructure was damaged. For this reason, the Iraqi government issued Investment Law No. 13 in 2006 finding out the principles contained in this Law from the current status of scientific research based on the enacted Investment Law and from the experiences of other developing countries. It is known that the problem of bringing foreign investment to developing countries is not an easy matter because foreign investors which intend to invest in a country depend, in decision making, on the balance between the expected profit and the risks. This equilibrium depends on; benefits and privileges that the host country provides, the country's political, economic and security stability, and the availability of applicable laws and regulations in the country provide these benefits and privileges. The sum of these considerations is called the“Investment environment”. Providing guarantees and privileges to foreign investors is the key for secure investment. These benefits and privileges such as; the provision of a suitable investment environment, the availability of economic resources which play an important role in attracting foreign investment, and providing protection against any future legislation and administrative procedures can be taken by the state to terminate or amend the rules of investment. Legal protection also ensures for the investor the right to enjoy the fruits of his investment which, in turn, encourages them to give more effort due to the benefits and effort, and this will reflex its results in the development of the country and structuring its economy which will be directly contributed. Due to the importance of foreign investment, especially for the development of the Iraqi economy, all the details of this subject will be discussed in this thesis.
