Özet
Seçme ve seçilme hakkı İnsan Hakları Evrensel Bildirgesinin 21. maddesinde ve Birleşmiş Milletler Sivil ve Siyasal Haklar Uluslararası Sözleşmesinin 25. maddesinde yer almakta ve dolayısıyla evrensel bir hak olarak kabul edilmektedir. Fakat seçme ve seçilme hakkının evrensel olmasının ne anlama geldiği ve bir insan hakkı olup olmadığının araştırılması gerekmektedir. Bu araştırmada seçme ve seçilme hakkı yönetme ve yönetilme hakkıyla ilgisinde ele alınmaktadır. Her hak görüşü belirli bir felsefi insan ve değer görüşüne dayandığı için, seçme ve seçilme hakkı ile yönetme ve yönetilme hakkının bir insan hakkı olarak felsefi açıdan temellendirilip temellendirilemeyeceğini sorgulamak zorundayız. Bu amaçla, Platon, Aristoteles, Mill, Huntington, Ringen, Dahl ve Kuçuradi gibi bu konuda farklı yaklaşımlara sahip filozofların insan, değer ve hak görüşleri karşılaştırılmıştır. Araştırmanın sonunda, antik dönemdeki temel soru olan“kim yönetmeli?”sorusunun günümüzde neden dikkate alınmadığı ve çok partili seçim sistemi ve seçme-seçilme hakkı üzerine oturtulan çağdaş liberal demokrasilerde insan haklarının tam anlamıyla korunup korunamayacağı açıklığa kavuşturulmaya çalışılmaktadır.

The right to elect and be elected has been mentioned in The Universal Declaration of Human Rights, Article 21., and in The United Nations International Covenant on Civil and Political Rights, Article 25., and consequently accepted as a universal right. However, whether the right to elect and be elected is a basic human right and what the meaning of being universal of that right is should be investigated. Through the investigation, the right to elect and be elected has been examined in connection with the right to govern. Since every idea of right depends on a certain concept of human-being and human value, we should research whether the right to elect and be elected can be founded philosophically as a human right. For this reason, we have compared and contrasted the different attitudes of various philosophers such as Plato, Aristotle, Mill, Ringen, Huntington, Dahl, Kuçuradi etc. in terms of their conceptions of the human-being, value and right. At the end of the study, we have tried to unravel the reason of why in these days the main question of ancient period“who should govern?”is not taken into consideration and whether human rights can be fully protected in the contemporary liberal democrasies that are basically established on the multi-party electoral system and the right to elect and be elected.
