Özet
“6102 Sayılı Türk Ticaret Kanunu'nun 1530'uncu Maddesi Uyarınca Mal ve Hizmet Tedarikinde Geç Ödemenin Sonuçları”başlıklı yüksek lisans tez çalışmamız 4 ana bölümden ve de sonuç kısmından oluşmaktadır. Çalışmamızın ilk bölümünde 2011/7/EU sayılı Direktif hükümleri ışığında Türk Ticaret Kanunu m. 1530 hükmünün kişi bakımından, konu bakımından ve zaman bakımından uygulama alanı ve de amacı açıklanmaya çalışılmıştır. İkinci bölümünde ticari işletmeler arasındaki mal ve hizmet tedariki sözelşmelerinde temerrüdün koşulları, üçüncü bölümünde de ticari işletmeler arasındaki mal ve hizmet tedariki sözleşmelerinde temerrüdün sonuçları ele alınmıştır. Çalışmamızın dördüncü bölümünü ise, 2011/7/EU sayılı Direktif'te yer alan diğer bazı hükümler oluşturmaktadır. Tez çalışmamızın sonuç kısmında ise yapılan inceleme ve araştırmaların neticesinde varılan sonuçlar ana hatları ile belirlenmiş konu ile ilgili olarak mevcut sorunlar için çözüm önerileri sunulmuştur.

This master's thesis, titled as 'The Consequences of Late Payment in Procurement of Goods and Services pursuant to the article 1530 of the Turkish Commercial Code No. 6102' consists of four main sections and a conclusion. The first section of the thesis aims to elucidate the purpose and the field of application of the article 1530 of the Turkish Commercial Code in terms of persons, subject matter and time considering the provisions of the Directive 2011/7/EU. The second section deals with the conditions for default of the debtor in contracts for the supply of goods and services between commercial enterprises while the third section deals with the consequences of the default of the debtor in contracts for the supply of goods and services between commercial enterprises. The fourth section studies the relevant provisions of the Directive 2011/7/EU. The final section of the thesis presents the findings of the research in light of the analysis conducted in previous sections and puts forward its own solutions to all existing challenges.
