Özet
Doktora tezimizde 6098 sayılı Türk Borçlar Kanunu ile adam çalıştıranın sorumluluğu hükmüne eklenen yeni düzenleme (m. 66/III), şartları ve sonuçları TBK m. 66/I ve II'de düzenlenen adam çalıştıranın olağan sorumluluğundan bağımsız bir sorumluluk temeli olarak kabul edilmektedir. Savunduğumuz görüş hem TBK m. 66/III hükmünün ifadesine hem de çağdaş hukuklarda son yıllarda sıklıkla dile getirilen modern ekonomik hayatta yoğun işbölümüne dayalı teknoloji temelli faaliyet gösteren işletmelerin sorumluluklarının on dokuzuncu yüzyıldaki kodifikasyonlarda esas alınan emek yoğunluklu küçük ve tarımsal işletmelere göre ağırlaştırılması gerektiği düşüncesine daha uygun düşmektedir. Tezimizde önce seçili hukuk düzenlerindeki adam çalıştıranın sorumluluğu müessesesi ile bu müesseseden yola çıkarak geliştirilen organizasyon sorumluluğu esasları incelenmektedir. Ardından Türk hukukunda TBK m. 66/III'te düzenlenen adam çalıştıranın organizasyon sorumluluğunun şartları ve sonuçları ortaya konmakta ve Türk hukukundaki benzer esasa dayanan çeşitli sorumluluklarla ilişkisi incelenmektedir. Tezimiz ile Türk hukukunda üreticinin sorumluluğu bakımından, adam çalıştıranın organizasyon sorumluluğunun bir çözüm getirip getirmediği de araştırılmaktadır.
Özet (Çeviri)
This Ph.D. thesis claims that a new seperate no-fault liability has been added by the Turkish Code of Obligations (TCO) numbered 6098 (entered into force on July,1 2012) to the liability of employers. According to this view, the ordinary liability of employers is regulated by the article 66/I and II. Besides organizational liability of employers is regulated by the article 66/III of the TCO. The perspective here supported is in accordance with the letter of the law and the movements towards stricter liability for modern enterprises within the contemporary legal systems of the world. Because as technology has advanced from simple hand tools to highly sophisticated technology, the organisation of enterprises, particularly the division of labor, has become more complex. Here first according to the determined contemporaray legal systems, the ordinary liability of employers and the basic principles of organizational liability of employers are demonstrated. Then the terms and results of the organizational liability of employers under Turkish Code of Obligations are clarified. Afterwards, the organizational liability is compared with the other reponsibilities based on similar justifications. Finally it is also examined that whether the organisational liability of employers under the article 66/III of the TCO is a solution for the products-liability problems in Turkish Law.
