Özet
Dini nasları anlama ve yorumlama metodolojisi olan usûl-i fıkıh iki temel metoda dayanmaktadır. Bunlardan biri tespit edilmiş asıllardan hareketle cüz'î meselelere çözüm getiren Mütekellimîn/Şâfiîyye metodudur. Diğeri ise fer'î meselelerden yola çıkarak usûlî kaideleri ortaya koyan Fukahâ/Hanefiyye yöntemidir. Farklı metotlar arasında ihtilafların varlığı kaçınılmaz olduğu gibi aynı metod mensupları arasında tartışmaların olması da doğaldır. Bu çalışma, İmâm Şâfiî'ye atfedilen metodolojik görüşler ile Şâfiî usûlcülerin muhalif olarak ortaya koydukları yaklaşım ve delilleri tespit etmeyi amaçlamaktadır. Tezimizde“Şer'î Deliller Bağlamında İmâm Şâfiî'ye Muhalefet Edilen Hususlar”başlığı altında Kitab, Sünnet, icmâ, kıyas ve bunlara ilişkin tartışmalar üzerinde durulmuştur. Bu ana başlıklar altında: Beyân kavramına yüklenen anlamlar, beyânın mertebeleri, Kur'ân'da Arapça dışında kelimelerin varlığı, nesh, Hz. Peygamber'in fiilleri, haber-i vâhid, mürsel haber, icmânın dayanakları, sükûtî icmânın delil olması, kıyas/ictihâd kavramları, kıyasın hücciyyeti, birden fazla illet ile hükmün ta'lîli konular gibi öne çıkan meseleler tartışılmıştır. Çalışmamızın“İstinbât Metotlarında İmâm Şâfiî'ye Muhalefet Edilen Temel hususlar”başlığını taşıyan bölümde ise harflerin manaları, emir-nehiy, âmm-hâss, mefhûm gibi daha çok“lâfız-mana-hüküm”merkezli lisânî tartışmalar serdedilmiştir. Bu çalışmamızda, Şâfiî usûlcülerin, genelde usûlün özüne halel getirmeden konuları farklı bir formatta ele aldıkları sonucuna varılmıştır. Nesh gibi sınırlı sayıda konu hariç genelde söz konusu ihtilaflar hakiki olmaktan ziyade lâfzî düzeyde kalmıştır. Bunun yanısıra pek çok tartışmanın, müşterek bir hükmü farklı açılardan ispat etme gibi olumlu sonuçları beraberinde getirdiği de tespit edilmiştir.

The usûl-i fıkıh which is the metodology of understanding and comment of religious dogma based on two basic methods. One of them is the method of Mütekellimîn/Şâfiiyye that bring solutions to the part issue of the original motion has been detected. The other is the method of Fukahâ/Hânefiyye that revealing procedural rules based on secondary issues. As well as the conflict between the different methods are inevitable it is also natural discussion about the same methods. This study aims to identify Imam Şâfiî's methodology in the understanding, interpretation issues and methodological opinions attributed to it. And it is also aims to identify evidences that put forward in oppositional approaches to the Şâfiî's methodists. In our study to focus on, under the heading of“ Evidence Obtained from Canonical Imam Şâfiî'y Issues in the Context of Opposition”, The Qurân, Sunnah,“icmâ”,“kıyâs”and the comparisons and discussion about them. Under these main headings were discussed the meanings loaded to the declared concept, steps of“beyân”, the presence of the non-arabic words in Qur'an,“Nesh”, actions of Hz. Prophet,“haber-i vâhid”, the“mürsel”news, the base of“icmâ”, to be evidence of Suküt-i icmâ, concepts of“kiyâs”and“icmâ”, evidence of“kıyâs”and the provision of multiple disease ta'lîl issues outstanding issues. Under the heading of our study“The Basic Points are being opposition of Imam Şâfiî'y at İstinbât Method”linguistic discussions contains which are means of letters,“emir-nehiy”,“âmm-hâss”and concept much like the especiality“lâfız-mana-hüküm”At our study, to get a conclision that how the Shafi'i methodologists handled of new methods and norms, without bringing any prejudice to the spirit and principles of Islamic law. Basically, these discussions except for some issues, such as abrogation, concluded that not the true disputes rather than literal. Beside of this, detected that these discussions have positive results like much of the discussions are try to prove a comman idea from different ways.
