Özet

Osmanlı Devleti'nde kadılar tarafından tutulan, merkezden gönderilen belgeleri, şer'i mahkemelerde verilen kararları, kadılara arzedilen şikâyetleri, kadıların merkeze gönderdikleri çeşitli konulardaki ilamları bünyesinde barındıran şeri'iyye sicilleri, dönemin hukuki, askeri, siyasi, iktisadi ve sosyal tarihini ortaya koyan en önemli başvuru kaynaklarıdır. Bölge tarihi araştırmalarına katkıda bulunmak amacıyla tez konusu olarak tercih ettiğimiz H. 15 Zilkade 1292-15 Rebiül-evvel 1295 (M. 1875-1878) tarihlerini kapsayan 2141 Nolu Safranbolu şer'iyye sicilinde, 114 hüccet, 76 ilâm, 3 buyruldu, Abdülaziz'in hal' edilmesinin ardından padişah olan V. Murat Han tarafından, isminin bölge camilerdeki hutbelerde zikredilmesinin istendiği bir ferman ile merkezden bölgeye gönderilen 2 adet telgraf bulunmaktadır. Dört bölümden oluşan çalışmamızın giriş bölümünü Safranbolu'nun Coğrafi Konumu ve Tarihçesi oluştururken birinci bölümde; Okuyucu ve araştırmacılarda alt yapı oluşturmak amacıyla ele aldığımız, Osmanlı hukukunun genel yapısı ile Şer'iyye mahkemeleri ve bu mahkemelerde yeralan görevliler, ikinci bölümde; şer'iyye sicillerinin tanımı, mahiyeti ve bu sicillerde yer alan bazı belge türleri, üçüncü bölümde; araştırmacılara kolaylık olması açısından belge türleri ve dava çeşitlerine göre tablolaştırdığımız belge özetleri, dördüncü bölümde ise 2141 Nolu Şer'iyye Sicilinin Transkripsiyonu yeralmaktadır.

At the time of Ottoman Empire, the religious records that embody all the documents sent from the center that are recorded by kadis, the decisions made in the ecclesiastical courts, the complaints submitted to kadis as well as the verdicts about various cases that would be sent to the center by kadis, constitute the most important reference materials that put forward the legal, military, politic, economic and social history of the period. There are 114 hujjats, 76 verdicts, 3 orders, 1 firman where the name of the Sultan Murat V. was requested to be alluded in the sermons of the local mosques after the dethronment of Sultan Abdülaziz as well as 2 telgraphes that were sent from the area to the center in Safranbolu Court Record Number 2141 that include the date H.15 Zilkade 1282-15 Rebiül-evvel 1295 (M. 1875 – 1878) which we preferred as the subject of our thesis with an attempt to make a contribution to the local history researches. While the Geogprahical Condition and History of Safranbolu constitutes the introduction part of our study which consists of four parts in total, the first part is comprised of the general structure of Ottoman Law and Ecclesiastical courts and the officials that took part in these courts, the second part consists of the definition and importance of ecclesiastical records and some kinds of docuements that are present in these records, the third part consists of the documents summary that we tabulated according to the types of cases so as to provide easiness for the reasearchers while the fourth part consists of the Transcription of Ecclesiastical Record Number 2141.
