Özet
Bu çalışmanın amacı, anayasal bir ilke olan ölçülülük ilkesinin, kolluğun zor ve silah kullanma uygulaması ve değerlendirmesi sürecinde bir ölçüt olarak kullanılmasını sağlamaktır. Çalışma konumuzu seçmede, bu alandaki teori ve pratik uygulama eksikliğini gidermek ana gerekçeyi oluşturmuştur. Zor ve silah kullanmada, bir sınırlandırma ve denetleme kriteri olarak ölçülülük ilkesi, örnek mahkeme kararları ve doktrindeki değerlendirmeleri genel bir bakış açısıyla incelendikten sonra, ilkenin kapsamı, niteliği, unsurları, yasal dayanakları, işlevleri ile teori ve uygulamadaki durumları ayrıntılı bir şekilde irdelenmiştir. İnceleme sonucunda kolluğun zor ve silah kullanma uygulamalarında ve değerlendirmelerinde ilkenin uygulanması ve görünümü ile ilgili önemli eksiklikler tespit edilmiştir. Çalışma sonunda, ölçülülük ilkesinin üç alt ilkesi olan gereklilik, elverişlilik ve orantılılık ilkeleri ile bunların sonuç analizini kapsayacak şekilde dört aşamalı olarak formüle edilen GE-EL-OR Ölçü Testi, kolluğun zor ve silah kullanabileceği her duruma uyarlanacak şekilde, yetkili makam ve kişilere, standart bir model önerisi olarak sunulmuş ve sağlayacağı faydalar ortaya konulmaya çalışılmıştır.

The purpose of this study is to ensure that the principle of proportionality which is a constitutional principle is used as a criteria in process and evaluation of use of force and arms by police. The main reason why we select this study subject is to address the lack of theory and practice in this area. The principle of proportionality as a measure in monitoring the use of force and arms, after an overview of the court decisions and doctrine, the scope of the principle, characteristics, elements, legal foundations, functions with theory and practical cases were discussed in detail. In the result of the study significant deficiencies regarding law enforcement's use of force and arms, implementation and evaluation of the principles and views have been identified. At the end of the study, with the analyze of necessity, suitability and balancing -the three sub-principles- a four-stage formulated test (GE-EL-OR Measure Test) which can be adapted to any use of force and arms case by law enforcement officers is presented to the authorities as a proposal and it is tried to expose the benefits of the test.
