Özet
Adam çalıştıranın sorumluluğu isimli bu çalışma adam çalıştıranın çalıştırdığı kişinin fiili neticesinde meydana gelen zararlarda, özellikle sorumluluğun unsurlarının neler olduğu ve bu unsurların sınırlarını belirlemek için hazırlanmıştır. Üç ana bölümden oluşan çalışmada ilk ana bölümde sorumluluk hukukuna ait genel bilgiler, adam çalıştıranın sorumluluğundaki temel kavramlar ve sorumluluğun hukuki niteliği incelenmiştir. İkinci bölüm ise kanımızca sorumluluğun sınırlarının belirlenmesi açısından önemle incelenmesi gereken sorumluluğun unsurları ve sorumluluk karinesi ile sorumluluktan kurtulma imkanları değerlendirilmiştir. Son bölümde ise sorumluluğun hukuki sonuçları üzerinde durulmuştur. Adam çalıştıranın sorumluluğu özen yükümüne dayanan bir sorumluluk türüdür. Çalıştıran özen yükümünü yerine getirmemesine dayanan kendi fiili sebebi ile sorumlu olmaktadır. Sorumluluğun doğması için ne adam çalıştıranın ne de çalıştırılanın kusurunun önemi yoktur. Ancak çalıştırılanın kusurunun bulunması halinde bu durum adam çalıştıranın ona rücu edebilmesine imkan verir.
Özet (Çeviri)
In this paper that is called The Responsibility of an Employer, is studying the actual damage to the employee which is done by the employer, especially to determine the elements of the responsibility and to determine the boundaries of these elements. In the first part of this paper that is a tripartite, the general description of liability law, the basic concepts of responsibility for the employer and the legal nature of the responsibility is studied. And the second part is about evaluating the possibilities of getting rid of the responsibilities with the presumption and the elements of the responsibility which is important to determine the boundaries of responsibility. And finally the legal consequences are presented in the last part. The responsibility of an employer is a specific kind of a responsibility, which depends on the duty of care. An employer that is not doing what is necessary based on the actual responsibility of his duty of care. It is not important to have a responsibility if it is a flaw of the employer or the employee. However, it is possible for the employee to recourse, in case of finding the flaw of the employer.
