Özet
Rehin hakkı, rehinle teminat altına alınan alacak, hiç veya gereği gibi ifa edilmediği takdirde, rehinli alacaklıya, rehin konusu malvarlığı değerini paraya çevirme ve paraya çevirme sonucunda elde edilen meblağı öncelikle alma yetkisi veren bir sınırlı ayni haktır. Bu kapsamda, anonim ortaklık payı üzerinde rehin tesis edilmesi ile birlikte, rehinli alacaklı, anonim ortaklık payını, rehinle teminat altına alınan alacaklar için“rezerve”eder. Eğer borçlu borcunu hiç veya gereği gibi ifa etmez ise, rehinli pay üzerinde, kendisinden tarih itibarıyla sonra gelen diğer hakları bertaraf ederek, rehinli payı paraya çevirebilir.
Özet (Çeviri)
The right of pledge is a limited real right that gives the creditor the power to liquidate the pledged assets or to claim the amount of money received by their liquidations before anyone else if the secured claim is not executed in full. In this context, the creditor“reserves”the share of a joint stock company for the secured claims as a pledge is established over the share of a joint stock company. If the debtor does not execute their debt at all or as is due, the creditor can liquidate the pledged share while setting aside other rights established after the pledge.
