SUMMARY The years after 1980's are very important f ör the emergence and progress of the law of environment. The reflection of universal being to Turkey and the occurance of time environmental conscios had provided many events to reach the judgement units. Advancements in environmental law and insufficiencies in legal regulations gave the units the possibility to make contributions to build a newly branch of law by using the doctrine in concrete cases. in this study, especialley in addition the contributions by administrative law to the environmental law, presenring environment by the lagal and administrative ways argued. Especially the contributions of court of cassation to the development of environmental law were regarded by investigating the way it comments the legal rules (cases) and administrative actions and transations. in introductory chapter of line thesis, the law and the environment, the right of environment andits guality were discussed, moreover the regulations related to the environmental issues in Turkey were also taken place. 161In the first chapter, after the conceptual emphasises on ownership and public benefit the matter how the relation between ownership and environmental values occures was regarded by certain judicial deersions. In addition; the approach of administral judgement to the relations between environment, urbanization and economy and tourism were taken into count. In the second shapter, in the administrative law in terms of the environmental matters cappability of case responsibility and the administrative guilties were searched with the specific judgements. Finally, the study was resulted by evaluating the approaches of the judgement related to environment. 162
