Özet
Taksitle satım sözleşmesi, tam iki tarafa borç yükleyen sözleşmelerdendir. Tam iki tarafa borç yükleyen sözleşmelerde her iki taraf da, birbirlerine karşı asli bir borç yüklenmektedir. Dolayısıyla her iki taraf da, hem alacaklı hem borçlu durumundadır. Taksitle satım sözleşmelerinde satıcının, satılanı alıcıya teslim etme borcuna karşılık alıcı da, satım bedelini kısım kısım ödeme borcu altına girmektedir. Bu kapsamda taksitle satım sözleşmesi, kredili (veresiye) satımın türlerindendir. 6098 sayılı Türk Borçlar Kanunu taksitle satım sözleşmelerine, 818 sayılı Borçlar Kanunu'na nazaran daha geniş yer vermiş ve kapsamlı olarak ele almıştır. Bu düzenlemelerin, yasanın yakın bir zamanda yürürlüğe girmiş olması nedeniyle uygulamada nasıl sorunlar getireceği henüz tespit edilememiştir. Bu çalışmanın öncelikli amacı, taksitle satım sözleşmesine yeni getirilen hükümleri ayrıntılarıyla ele almak ve uygulamada oluşturacağı sorunları ve getireceği faydaları tespit etmektir.

İnstallment sale contracts is one of the contracts that burdens with debt to both sides. In contracts which burdens with debt to both sides have fundamental debt burden to each other. So, both sides are both a creditor and a debitor. In installment sale contracts in response to the commitment debt for sold of seller, buyer has also debt burden and seller must pay the sale price in parts. Within this scope, the installment sale contracts is one of the types of a sale account. İnstallment sale contract pursuants to turkish code of obligations no 6098 is more comprehensive and has much more places than the code of obligations no 818. These regulations and laws have come into effect recently because of that reason it is not determined that what kind of problems can happen in practice.The first aim of this research is to analyze the new provisions came to installment sale contracts and to determine the benefits of it and the problems it can cause in practice.
