This paper examines the current private antitrust enforcement policy on the notions of 'passing-on defence' and indirect purchaser suits in the EU and US in order to determine the best policy choice for Turkey. EU and US laws are considered as being the major jurisdictions and lessons should be drawn from their policies regarding 'passing-on defence' and indirect purchaser standing for the future application of private litigation in Turkey in order to provide an effective enforcement of competition rules. The paper argues that it might be worthwhile to establish this policy in Turkey to allow locus standi of indirect purchasers while rejecting the 'passing-on defence' according to the unique characteristics and structures of Turkish competition law and its application to date.
