This paper examines whether the emergence and implementation of R2P has contributed to the recognition, legality and the legitimacy of humanitarian intervention in theory and in practice. R2P is a political norm yet to become a legal one that focuses on protecting civilians and defines sovereignty as responsibility. First of all, Humanitarian intervention and the ideas regarding its legitimacy will be assessed by focusing on NATO intervention in the Kosovo Conflict. Then the Paper will summarize Responsibility to Protect's emergence in the UN and how it contributes to the humanitarian intervention debates. Secondly, Responsibility to react, and the criteria proposed by ICISS Report to ensure legitimacy will be explored and how these criteria have been implemented in recent examples of Darfur and Libya will be discussed. Taking into account that the humanitarian intervention without any Security Council authorization is not in conformity with international law and the UN Charter, the paper suggests that R2P offers a solid and applicable framework to guide future interventions for humanitarian purposes.
