Özet
“Özel Kanunlarda Düzenlenen İlâm Niteliğinde Belgeler”isimli yüksek lisans tezimiz üç ana bölümden oluşmaktadır. Birinci bölümde ilâmlı icra, ilâmlı icra takibinin dayanakları ve ilâmlar ile ilâm niteliğinde belgeler arasındaki ne gibi farklılıkların olduğu; ikinci bölümde, özel kanunlarda düzenlenen ilâm niteliğinde belgelerin neler olduğu, bu belgelerin hukukî niteliği, ilâm niteliğinde belge olabilmesinin şartları, şekli ve içeriği, hükmü ve icrası hususları teorik ve Yargıtay kararları ışığında açıklanmıştır. Üçüncü bölümde ise ilâm niteliğinde belgelerin yerine getirilmesi prosedürü yetkili icra dairesi, takip talebi, icra emri, şikâyet, icranın geri bırakılması, menfi tespit ve istirdat davası ile haciz, satış, iflas talep edebilme yetkisine ilişkin ilâmlı icra hükümleri dikkate alınarak değerlendirilmeye çalışılmıştır.

Our Master Thesis on Judgement Qualification Documents arranged in Private Laws consists of three main sections. In the first section, the differences among the proceeding of execution, the basis of following the execution proceeding, judgements and Judgement Qualification Documents; in the second section what the Judgement Qualification Documents arranged in Private Laws are, Legal nature of these documents, conditions of being a judgement qualification document, form and content, subjects od decision and execution have been explained theoretically and in the light of Yargıtay decisions. In the third section, the Procedure of Fulfilment of Judgement Qualification Documents; authorized executive office, follow-up request, writ of execution, complaint, the postponement of execution, foreclosure, sales, to demand bankruptcy with negative clearance and proceedings on restitution related to the proceeding of enforcement provisions have been evaluated.
