Özet
Beden muayenesi ve vücuttan örnek alma, 5271 Sayılı Ceza Muhakeme sinin Kanunun 75 - 82.maddelerinde ve ayrıca Ceza Muhakemesinde Beden Muayenesi Genetik İncelemeler ve Fizik Kimliğinin Tespiti Hakkında Yönetmeliğinde ayrıntılı olarak düzenlenmiş olup, beden muayenesi ve vücuttan örnek alma, doğrudan vücut bütünlüğüne yöne lik müdahale niteliğinde işlemlerdendir. Vücut bütünlüğünün dokunulmazlığı ve ihlali her ne kadar Anayasada güvence altına alınmışsa da, bu işlemlere uygulanacak tedbir kapsamında Ceza Muhakemesi Kanununda ve Yönetmelikte ayrıntılı bir şekilde düzenlenm iş ve önceki kanun döneminde var olan boşluğu doldurarak bu konudaki ihtiyaca cevap vermektedir. Beden muayenesi şüpheli, sanık, diğer muhakeme süjeleri ve kadının beden inde inceleme yapılmasını ve vücuttan alınan örnekler neticesinde; muhakeme hukukunda delil elde etmek ve elde edilen delilleri değerlendirmek bakımından büyük önem taşımaktadır. Kanunda şüpheli ve sanık açısından sadece iç beden muayenesine ve vücuttan örnek alınmasına yer verilirken, dış beden muayenesi Yönetmeliğin düzenleme alanına b ırakılmıştır. Diğer muhakeme süjeleri için ise kanunda hem iç ve dış beden muayenesi, hem de vücuttan örnek alınmasına ilişkin hükümler öngörülmektedir.

Physical examination and the body sampling, 5271 Criminal P rocedure Law of the 75 - Article 82 , and also in the Criminal Procedure Physical Examination Genetic Studies and Physical Identity Detection in the regulation stipulated in detail and , physical examination and body sampling,are the direct physical integr ity interventions in the nature of the process. Although being under the guarantee of the Constitution ,body integrity immunity and the violation operations measure to be implemented and arranged in detail under the Criminal Procedure Law and Regulation and give the necessary answer by filling the existing gap on this issue in the previous legislation . Physical examination of the suspect, the accused , the other judge in the subject and the body of the woman's examination and investigation as a result of samples taken from the body ;has great importance in terms of reasoning in law to obtain evidence and assess the evidence obtained . Whereas it is only given place to the internal physical examination and taking samples from the body in terms of susp ects and defendants in domestic law, only in terms of physical examination and the taking of samples from the body to the given place , the external physical examination is left to the editing area of the regulation. For the other judgment subjects, both external and internal physical examination , as well as provisions relating to the taking of samples from the body is anticipated on the law.
