Özet
Bünyesinde bir çok eğilim ve oluşumu, sosyal, ekonomik, siyasal, kültürel, psikolojik ve düşünsel boyutları bulunan bir süreci ifade eden modernleşme kavramı esas olarak, geleneksel toplumdan modern topluma doğru yönelen hızlı ve köklü değişimi ifade eder. Hukukun en önemli işlevi toplumdaki düzeni sağlaması ya da toplumdaki düzene katkıda bulunmasıdır. Bu bağlamda bir toplumun modernleşip modernleşmediği, o topluma uygulanan hukuk kurallarına bakılarak anlaşılabilir. Modern bir devletin hukuksal yapısı anayasa temeli üzerine kurulur. Anayasa, devleti oluşturan ve vatandaşların temel hak ve özgürlüklerini koruyan en önemli belgedir; siyasal iktidarın kullanılmasını sınırlayan ve denetlenmesini sağlayan hukuksal araçtır; aynı zamanda ekonomik ve toplumsal alanda siyasal iktidara yön veren temel kuralları düzenler. Bu açıdan bakıldığında modern bir devletin anayasasının olması gereklidir. Türkiye'de anayasal düzene ilk geçiş sürecinden günümüze kadar modernleşmenin anayasal ve kurumsal inşa bağlamında değişimi, bu araştırmanın temel konusunu oluşturmaktadır. Bu çerçevede, modernleşme ve anayasa kavramlarının tartışılması, Türkiye'de anayasal düzene geçişte toplumsal ve kurumsal değişimlerin analizi yapılarak, anayasaların ve anayasa değişikliklerinin modernleşme sürecine etkisi incelenmektedir

The modernization concept, which expresses a period that has many inclinations and constitutions, social, economical, political, cultural, psychological and intellectual facets in itself, actually phrases the fast and long-established change which heads from the traditional society to the modern society. The most important role of the law is to provide or contribute the social order of the society. In this context, whether a society is modernized or not can be understand by examining the implemented legal principals. Law frame of a modern state is set upon the constitutional law. The constitution is the most important document which establishes the state and preserves the fundamental rights and freedoms of the citizens, the constitution is forensic instrument which limits use and facilitates supervision of the political might; also the constitution regulates basic rules which steer the political might in economical and social extent. In this regard, a modern state has to have a constitution. The change of the modernization within the context of constitutional and instutional construction from the first transition period of the constitutional order till modern-day, forms basic subject of this research. In this context, debate of the modernization and the constitution concepts, the effect of the constitutions and constitutional transformations on the modernization process by analysing social and institutional changes during transition to constitutional order in Turkey are investigated
