Özet
Bu çalışmanın konusu;“6502 sayılı Kanun Kapsamında Paket Tur Sözleşmesi”dir. Paket tur sözleşmesinin tanımının şu şekilde yapılması mümkündür:“Toptan bir fiyat karşılığında satışa sunulan hizmetlerin 24 saatten uzun veya en az bir gecelik konaklamayı kapsadığı ve ulaşım, konaklama veya diğer asli nitelikteki edimlerden en az ikisini içeren sözleşmelerdir”. 6502 sayılı Kanun'da yer alan hükümlere ve bahsi geçen Kanun'a binaen çıkarılacak Yönetmeliklere yol göstermek amacıyla bazı tekliflerde bulunmak da tez konusunun seçilmesinde etkili olmuştur. Yine, paket tur sözleşmeleri konusunda bugüne kadar monografik bir çalışmanın yapılmamış olması, tez konusunun seçimindeki sebeplerden birisidir. İncelememiz üç“Bölüm”ve bir“Sonuç”tan meydana gelmektedir. Birinci bölümde, paket tur sözleşmesinin tanımı, unsurları, tarafları ve kurulması konuları ele alınmıştır. İkinci bölümde, mukayeseli hukukta ve Türk hukukunda paket tur sözleşmesinin hukukî niteliği ele alınmakla birlikte, Yönerge ve Türk Hukuku dikkate alınarak paket tur sözleşmesinde tarafların hakları ve borçları konusu ayrıntılı olarak incelenmiştir. Nihayet çalışmanın üçüncü bölümünde, paket tur sözleşmesinin hüküm ve sonuçlarına yer verilmiştir. Bu bölümde son olarak, paket tur sözleşmesinin sona ermesi ve zamanaşımı müesseseleri incelenmiştir. İncelememiz sırasında vardığımız kanaatler, toplu bir şekilde“Sonuç”kısmında yer almaktadır.

This study deals with“Package Tour Contract within the Scope of the Law no. 6502”. Package tour contract can be defined as follows:“Package tour contract is a contract covering the combination of not fewer than two of the transport, accommodation and other principal operations put up for sale at a wholesale price that cover a period of more than twenty-four hours or include minimum one overnight accommodation.”One of the purposes of this thesis is intention to make some suggestions to shed light on the provisions included in the Law no. 6502 and to guide the Regulations to be introduced as per the said Law is also influential on the selection of the thesis subject. Another reason for the adoption of this thesis subject is the fact that no monographic study has been conducted on package tour contracts so far. The present study consists of three“Chapters”and one“Conclusion”. The first chapter deals with the definition, elements, parties, and draw-up of package tour contracts. The second chapter addresses the legal character of package tour contract in comparative law and Turkish law and examines in detail the rights and obligations of parties in package tour contract on the basis of the Directive and Turkish Law. Finally, the third chapter focuses on the provisions and results of package tour contract. This chapter also deals with termination and prescription of package tour contract. The conclusions we have reached throughout our examination are presented in“Conclusion”collectively.
