Özet
Bu çalışmanın amacı, Kuran ve Sünnet bütünlüğü içerisinde Kur?an?da cezanın amacının neler olduğunu tespit etmeye çalışmaktır. Konu her ne kadar ?Kur?an ve Sünnet? çerçevesinde ele alınmış olsa da, tabii olarak çalışmanın ilgili yerlerinde İslam Hukuku ve Batı Hukuku?nda ne şekilde değerlendirildiğine de yer verilmiştir. Temel olarak bu çalışma, giriş ve sonuç dışında üç bölümden oluşmaktadır.İlk bölümde, cezanın tanımı, tarihi, İslam hukukuna göre cezaların tasnifi ve Kur?an?da cezanın özelliklerinin neler olduğu konuları yer almaktadır. ?Kur?an ve Sünnet?te, İslam Hukuku?nda ve Batı Kaynaklı Hukukta Cezanın Amacı ? başlıklı ikinci bölümde, Kur?an?ın dünya ve ahiret hayatında cezalandırma için ne gibi amaçlar gözettiği konusu ele alınmış, suçtan etkilenen taraflar olan fail, mağdur ve toplum için cezada hangi amaçların gözetildiği konularına yer verilmiştir. Ardından İslam hukukunda ve batı kaynaklı hukukta cezanın amacını açıklayan akımlar ve düşünürlerin görüşlerine yer verilmiştir. ?Kur?an ve Sünnet?te Yer Alan Örnek Suç Türlerinde Cezanın Amacı? başlıklı üçüncü bölümde Kur?an-ı Kerim?de örnek olarak zikredilen cezalarda ne gibi amaçların gözetildiği konusu verilmiş ve birinci bölümde tespit edilen ?cezanın özellikleri? dikkate alınarak kritik edilmiştir. Sonuç bölümünde ise, çalışma neticesinde ulaşılan tespitlere ve önerilere yer verilmiştir.

The purpose of this study, with the entirety of Qur'an and Sunnah, trying determine what the punishment in Qur'an. Although subject to the“Quran and Sunnah”has been discussed within the framework of the relevant parts of the study naturally been assessed as what is found in Islamic Law. Basically, this study consists of three parts except the introduction and conclusion. In the first part of this study, sentence definition, classification and punishment according to Islamic law, what are the characteristics of the sentence are explained in the Qur'an. On the second section“Philosophy on The Purpose of Punishment”describes the purpose of the punishment in Islamic law and modern law and the opinions of trends and philosophers. Then, the application of Islamic law and modern law of peace and the different aspects of mediation compared to similar institutions. In the third chapter titled as“In the Light of the Qur'an and the Sunnah of the Basic Criminal Purposes”main aim is the purposes of sentencing as called in in the Qur'an that it sets in the world and in the Hereafter is discussed. Then, with the parties affected by crime, the offender, the victim and the community in which the objectives are respected in criminal matters are discussed. In the last part of the study, penalties mentioned in the Qur'an as to what the objectives given to respected and identified in the first chapter of the“properties of punishment”has been a criticised consideration. In the conclusion, the study findings and the recommendations are achieved as a result.
