Özet
Etik konusu gün geçtikçe daha fazla önem kazanmaktadır. Hem kamu hem de özel sektör alanında artan yolsuzluklar, etik konusuna duyulan ihtiyacı şiddetlendirmektedir. Yolsuzlukların başlıca nedenleri katı bürokrasi, ahlaki aşınma ve yaptırımların yetersizliği olarak görülmekte, böylece yolsuzluklar çoğaldıkça etik bir sisteme duyulan ihtiyacın da arttığı gözlenmektedir. Etik dışı tutumlar ve yolsuzlukların önlenmesinde insanoğlunun başta gelen aracı yargıdır. Gerçekten her yönüyle sağlam bir yargı mekanizması kurulu olan devletler ekonomik kalkınmadan, gelir adaletine kadar bir çok alanda başarılı olabilmektedir. İşte bu sebeple bir ülkede konu yolsuzluklar olduğunda önce o ülkenin yargı sistemine bakmak ve yargının etik bir yapılanmaya sahip olup olmadığını görmek gereklidir. Bu çalışmada öncelikle Türkiye Yargısı?nın sistemsel olarak etik bir yapılanmaya sahip olup olmadığı incelenmiştir. Bu kapsamda yargıdaki aşırı bürokratik ve kırtasiyeci uygulamaların etik yönden sonuçları ortaya konulmuş, yeni kamu yönetimi ve çağdaş işletmecilik anlayışının hangi sorunlara çözüm olacağı ve ne gibi ilerlemeleri sağlayacağı ortaya konulmaya çalşılmıştır. Bunun için yabancı ülke uygulamaları değerlendirilmiş bunun yanında Yargıtay bünyesinde görev yapan tetkik hakimlerine 25 sorudan oluşan bir anket uygulanmıştır. Etik konusunda yazılan yazılar ve bilimsel çalışmalarda daha çok çalışanların kişisel etik algıları ölçülmeye çalışılmaktadır. Örgütler kendi sistemlerine çeki düzen vermeden ve etik konusunda özendirici bir yapılanmaya kavuşmadan çalışanlarından yüksek etik standartlar bekleyemeyeceklerinden, etik dışılıklara sebep olan sistemsel kusurları tespit etmeye yönelik anket soruları hazırlanmıştır. Ayrıca bu anket çalışmasında hakimlerin etik algılarının ölçülmesine yönelik sorulara da yer verilmiştir. Diğer ülke uygulamalarının değerlendirilmesi ve anket çalışması sonucunda yargıdaki etik dışı uygulamaların temel sebebinin aşırı bürokrasi ve bazı sistemsel kusurlar olduğu tespit edilmiştir.

The issue of ethics is gaining more and more importance with each passing day. Increasing corruption in both public and private sector compounds the need for the issue of ethics. The main causes of corruption are seen as rigid bureaucracy, moral corrosion and inadequate sanctions; therefore, as corruption increases, it is observed that orientation to ethical structure grows. Justice is the primary agent to prevent unethical attitude and corruptions. Governments with well established judicial mechanism in every aspect will be successful in many fields ranging from economic development to equity of income. Because of this reason, when there is a good deal of corruption in a country, we should first examine the judicial system and see if the judgement has an ethical structure for that country. In this study, it is primarily investigated if Turkish Jurisdiction has got a systematical ethical structure. In this context, the ethical results of the excessive bureaucratic applications in judge have been revealed, and it has been tried to present for which problems the conception of new public administration and contemporary management can cure and what sort of developments it provides. Therefore, applications in the foreign countries have been evaluated, and a survey consisting of 25 questions was also conducted on the investigating judges serving at the Supreme Court. The personal ethical perception of the employees is often tried to get measured in the articles and the scientific studies written on ethics. Since the organizations can?t expect the high ethical standards from their employees before tidying up their own system and without having an incentive configuration on ethics, the survey questions have been prepared in order to determine the systemic faults causing the unethical matters other than mesasuring the individual perceptions. In addition, there also exist the questions intending to evaluate the ethical perceptions of the judges in this survey. As the result of evaluating the applications of the foreign countries and the survey study, it has been determined that the main reason for the unethical applications in justice is the excessive bureaucracy and some systematic deficits.
