Özet
?Ticarî İş ve Sonuçları? isimli bu çalışmanın amacı, ticarî iş kavramının ve bu kavrama bağlanan sonuçların incelenmesidir. Bu incelemeler, 1.7.2012 tarih ve 6102 sayılı Türk Ticaret Kanunu hükümleri esas alınarak yapılmıştır. Ticarî işler, Türk Ticaret Kanununun 3. ve 19. maddelerinde düzenlenmiştir. Bu şekilde, ticarî işler ile ticarî olmayan (adi) işler ayırt edilmiştir. Bu ayrım, ticarî işlere özgü somut bir takım sonuçlar bağlanabilmesini sağlamıştır. Bu sonuçların başında, ticarî işlere, öncelikli olarak ticarî hükümlerin uygulanması gelir. Ayrıca, Türk Ticaret Kanunu?nda, bu kavrama bağlı olarak; ticarî işlerde teselsül karinesi, ticarî faiz ve zamanaşımı gibi özel sonuçlar düzenlenmektedir. Bu tez çalışması, üç ana bölümden oluşmaktadır. Birinci bölümde, ticari iş kavramı ve bu kavramın nitelendirilmesinde kullanılan kriterler; ikinci bölümde, ticari işe bağlanan özel sonuçlar; Üçüncü bölümde ise, ticari işlere uygulanacak hükümler incelenmiştir.

The purpose of this study named as ?Commercial Business and its consequences? is to analyze the concept ?commercial business? and the results based on this concept. The analysis were conducted based on the provisions of Turkish Commercial Code dated 1.7.2012 under code no. 6102.Commercial businesses are regulated in accordance with articles no. 3 and 19 of Turkish Commercial Code. This way, the commercial businesses and non-commercial businesses were distinguished. This separation was based on the fact that some abstract results may be connected with commercial affairs. Among these results, the priority comes with the implementation of the commercial provisions to the commercial affairs. Furthermore, in Turkish Commercial Code, based on this concept; special consequences are regulated such as presumption of solidarity, commercial interest and time bar.This thesis consists of three main groups. In the first section, the concept commercial business and the criterions used in qualification of this concept; in the second section, special consequences connected with the commercial business and in the third section, the provisions applicable to the commercial businesses were analyzed.
