Özet
Devlet sağlık hizmetleri alanında görevli kılınmış olup Anayasa?nın 56. maddesinde devletin bu görevini kamu ve özel kesimlerdeki sağlık ve sosyal kurumlarından yararlanarak ve onları denetleyerek yerine getireceği hüküm altına alınmıştır. Bunun bir sonucu olarak, bu görevin gereği gibi yerine getirilmemesi durumunda devletin sorumluluğu gündeme gelecektir. Türk hukukunda idarenin sağlık hizmetlerinin yürütülmesinden kaynaklanan sorumluluğunu düzenleyen özel bir yasal düzenleme bulunmamaktadır. Dolayısıyla idarenin bu alandaki sorumluluğu daha ziyade uygulamada yargısal içtihatlarla şekillenmektedir. Bu noktada, idarenin sağlık hizmetleri alanındaki sorumluluğuna ilişkin özel bir yasal düzenlemenin bulunmayışı ve bu durumun getirmiş olduğu belirsizlik, Danıştay?ın sağlık hizmetleri alanındaki sorumluluk anlayışı ve doktrinde bu konuda görüş birliğinin bulunmaması, konuyu ilgi çekici ve araştırmaya değer kılmaktadır. Bu itibarla hazırlanan çalışmada, idarenin sağlık hizmetlerinin yürütülmesinden kaynaklanan sorumluluğu konusu, pozitif düzenlemeler ve sorumluluk sistemleri temelinde, doktrindeki görüşler ve yargısal içtihatlardan faydalanılmak suretiyle akademik bir bakış açısıyla sunulmaya çalışılmıştır.

The State is responsible for the health services and it is stipulated under the Article 56 of the Constitution that the State fulfills this responsibility benefiting from and controlling public and private health and social institutions. As a result, liability of the state occurs in case that the mentioned responsibility is not performed. Within Turkish Law, there is no specific regulation regarding the liability of the administration arising from the performing the health services. Thus, the liability of the administration is mostly determined through jurisprudences. At this point, non-existence of any specific regulation regarding the liabilities of the administration for the health services and the vagueness arising from this mentioned situation, the perception of the Council of State regarding the liabilities in the health services field and non-existence of a consensus among the doctrine regarding this issue, make the subject attractive and worth to study and make researches on. In this respect, in this present work, the subject consisting of the liabilities of the administration regarding the performance of the health services is aimed to be presented on an academic point of view, benefiting from the views of the doctrine and jurisprudences, on the basis of positive regulations and liability systems.
