Özet
ÖZETBu çalışma; cinsel istismar mağduru çocukların suç sonrasında, soruşturma ve kovuşturma aşamalarındaki karşılaştıkları problemleri, maruz kaldıkları durum ve tutumları tespit etmek, ceza adalet çalışanlarının mağdur çocuklarla ilgili düşünce ve önerilerini belirlemek ve Ceza Adalet Reformu kapsamında yapılan yasal değişikliklerin uygulamasını görmek amacıyla yapılmıştır. Bu amaçla ceza adalet çalışanlarına anket uygulanmış, ayrıca Çanakkale Adliyesi'ne ?çocukların cinsel istismarı? suçu nedeniyle açılan dava dosyaları incelenmiş, sonuçlar çeşitli yönlerden değerlendirilmiştir.Ankete katılan ceza adalet çalışanlarının %49'u Cumhuriyet savcısı, %41'i hakim ve %10'u ise diğer adalet çalışanlarıdır. Katılımcıların %39,8'i cinsel suç mağduru çocukların soruşturma ve kovuşturma aşamasında en az iki kez, %45,4'ü ise en az üç kez ifadelerinin alındığını; %57,7'si mağdurların bu süreçte en az iki kez doktor muayenesinden geçtiğini, %23,7'si en az üç kez muayene edildiğini belirtmişlerdir.İncelenen Ağır Ceza Mahkemesi dava dosyalarında; mağdurların %80,3'ünün kız,%19,6'sının erkek olduğu, %63,9'unun 11-15 yaş grubunda,%20,7'sinin 16-18 yaş grubunda, %15,3'ünün 10 yaş ve altında olduğu, bu dosyaların %63,6'sında mağdurların nitelikli cinsel istismara, %25,5'inin basit cinsel istismara maruz kaldığı, %14,4'ünde ise reşit olmayanla cinsel ilişki suçunun işlendiği görülmüştür. Aynı mahkemedeki karara çıkan dosyalarda mağdurların %46,9'unun 2 kez, %19,6'sının 3 kez ifadesinin alındığı, yine bu dosyalarda mağdurların %32'8'inin 2 kez, %20'sinin 3 kez, %7,1'inin ise 4 ve daha fazla kez muayene edildiği tespit edilmiştir. Belirtilen mahkemede 01 Haziran 2005 sonrası cinsel suç mağduru çocukların tamamının avukatının olduğu, tamamına yakının ifadelerinin alınması sırasında uzman bir kişinin bulunduğu görülmüştür.

SUMMARYThis study examines problems child victims of sexual exploitation encounter during the investigation and prosecution of the crime, identifies issues they face, detects opinions and attitudes of the criminal justice professionals, and studies the implementation of the Criminal Justice Reform. Toward this end, the criminal justice professionals are surveyed, the ?Child Sexual Abuse? cases filed at the Court of Canakkale are examined, and the findings are evaluated.The sample includes public prosecutors (49 percent), judges (41 percent), and other criminal justice professionals (10 percent). Of the participants, 39.8 percent mentioned that they have taken statements from the child victims of sexual crime at least twice and 45.4 percent of those who participated into this survey stated that the statements were taken at least three times. 57.7 percent of the participants stated that the victims were examined by a doctor at least twice and 23.7 percent of the surveyed professionals stated that the victims were seen by a doctor at least three times.The analysis of Heavy Penal Court case files reveals that 80.3 percent of the victims are female and 19.6 percent are male. Of the victims 63.9 percent are between the ages of 11 and 15, 20.7 percent are between the ages of 16 and 18, and 15.3 percent are 10 years old or younger. In 63.3 percent of the cases that were examined the victims were exposed to qualified sexual abuse, in 25.5 percent of the cases the victims were exposed to simple sexual abuse, and in 14.4 percent of the cases the offense was committed against a minor. The analysis of the same data indicates that 46.9 percent of the victims gave statements twice, and 19.6 percent of them gave statements three times. Similarly, of the victims 32.8 percent were examined by a doctor twice, 20 percent 3 times, and 7.1 percent of the victims were examined 4 times or more. The analysis of the same court files also shows that as of June 1, 2005, all the child victims of sexual abuse had an attorney, and in nearly all cases an expert was present when the statement was taken.
