Özet
Bu tez kapsamında Fikri Hukuk'da tazminat davalarına geçilmeden önce, Fikri Hukuk'daki kavramlar üzerinde durulmuş, eser ve eser sahipliğinden bahsedilmiştir. Daha sonra ise tazminat hukukunun temeli olan haksız fiil sorumluluğunu düzenleyen Borçlar Kanunu anlamında haksız fiil, zarar ve tazminat kavramlarına değinilmiştir. Ardından, manevi ve mali haklar ile bunların nitelik ve içerikleri irdelenmiştir. Çünkü fikri hukuk açısından tazminat sorumluluğu, eser sahibinin manevi veya mali bir hakkının ihlal edilmesi durumunda doğar. Manevi ve mali haklar da Fikir ve Sanat Eserleri Kanunu'nda gösterilen, eser sahipliğine dayanan haklar olduğundan bunların açıklanmasında fayda görülmüştür. Daha sonra ise manevi ve mali hak ihlalleri halinde açılabilecek tazminat davaları ve kazancın iadesi davası açıklanmıştır. Devamında mali hakların ihlali halinde açılabilecek tecavüzün ref'i davası vurgulanmak suretiyle tecavüzün ref'i ve men'i davalarından söz edilmiştir. Son kısmında ise tüm bu davalarda uygulanacak yargılama usulüne ver verilmiştir.Tezimizin son kısmında ise konuya ilişkin vardığımız sonuç belirtilmiştir.

Within the scope of this thesis, before explaining lawsuits of damages in intellectual property law, the concepts of intellectual property law are accentuated, work and the ownership of the work are referred to. Then the concepts tort, damage and damages within the scope of Law on Obligations regulating the liability of tort which is the basis of the law of damages are mentioned. Subsequently, the moral and financial rights and the quality and contents of these are studied. Forasmuchas the liability of damages in terms of intellectual property law arises provided that a moral or financial right of the owner of the work is violated. Because the moral and financial rights are also indicated as the rights relying on the ownership of the work in the Law on Intellectual and Artistic Works, it seems useful to explain these issues. Then the lawsuits of damages that can be brought before the court in case of violations of moral and financial rights and the lawsuit of the refund of the earnings are explained. Afterwards, by emphasizing the lawsuit of annihilation of infringement which can be brought before the court when there is a violation of financial rights, the lawsuits of annihilation and prevention of infringement are mentioned. In the last part, the proceedings to be applied in all these lawsuits are discussed.In the conclusion part of our thesis, the result that we reach is revealed.
