Özet
Bu çalışmada, Türk Hukukuna yeni girmiş olan Aile Konutu ve İsviçre Medeni Kanunundan farklı olarak kabul edilen şerh olanağı ele alınmıştır.Bu inceleme yapılırken birinci bölümde, Türk Medeni Kanunu'ndaki aile hukuku reformu, aile ve ailenin korunması konuları genel hatları ile incelendikten sonra, konumuzun ana esasını teşkil eden ancak Türk Medeni Kanunu'nda tanımı yapılmayan Aile Konutu'nun ne olduğunu daha iyi anlayabilmek için `aile' ve `konut' kavramları tek tek incelenerek Aile Konutu kavramı hakkında Türk doktrininde yer alan tanımlamalar ile bir sonuca varılmaya çalışılmıştır. Daha sonra aile konutunu oluşturan unsurlar ve aile konutunun önemi açıklanmaya çalışılmıştır.İkinci bölümde; Türk Medeni Kanun'unun evliliğin genel hükümleri, mal rejimleri ve miras hukuku bölümlerinde yer alan aile konutu hükümleri ayrıntılı olarak incelenmiş ve TMK m. 194/1 kapsamında aile konutu ile ilgili diğer eşin rızasını gerektiren işlemler ile rızanın hukuki mahiyeti örnek Yargıtay kararları da nazara alınarak ele alınmıştır.Üçüncü bölümde ise aile konutu hakkında hak sahibi olmayan eşin tapuya koydurabileceği aile konutu şerhi kurumu hukuki mahiyeti, şartları ve etkisi Türk doktrinindeki görüşler ışığında incelenmiştir

In this study, family dwelling which has recently taken place in the Turkish Law; and as the protection, the possibility of annotation that is accepted different from the Swiss Civil Code was discussed.During this study, in the first section, in order to apprehend the family dwelling which makes up the core structure of the subject but which has no accurate definiton in the Turkish Civil Code, it was tried to a conclusion with the definitions which exist in the Turkish Doctrine about the concept of the Family Dwelling after discussing the family and the dwelling severally. Afterwards it was tried to examine the importance of family dwelling and the elements forming it.In the second section, the general provisions of the marriage, property regimes in the Turkish Civil Code and the provisions of housing contained in the section of inheritance law has been examined in detail; and in the context of TMC 194/1 about the family housing, the process requiring the other spouse's consent and the legal nature of the consent has been dealt by considering the sample the Supreme Court decisions.In the third section, the family dwelling annotation which the ineligible spouse on the family dwelling can put on the title deed, conditions and effects were examined in the light of the views on Turkish doctrine.
