?İşkencenin Belgelendirilmesine Dair İstanbul Protokolü?, Yüksek Lisans Tezi, Ankara, 2007Başlangıçta, cezalandırma yöntemi veya ispat aracı olarak kullanılan işkence, tarihsel süreç içerisinde mutlak bir yasak olarak bir çok uluslararası belgeye konu olmuştur. Ancak İşkence yasağının, uluslararası belgeler ve ulusal mevzuatlarda yer alması, uygulamada yaşanan işkence olaylarının önlenmesine yetmemiştir.İşkence ihlallerinin önlenmesindeki zorluk ve önem, uluslararası kurum ve kuruluşları bu alanda ortak çalışmaya zorlamıştır. Bu çalışmalar sonucu oluşturulan belgelerden biride, İstanbul Protokolü'dür.İstanbul Protokolü'nü esas alan bu çalışmamızda, işkence yasağının tarihsel gelişimi, işkencenin soruşturulmasında dikkat edilecek ilkeler, işkencenin tıbbi delillerle belgelenmesi ve hukuki açıdan soruşturulması konuları ele alınmıştır. Bu konuyla ilgili uluslararası belgeler incelenmiş ve AİHM kararlarına değinilmiştir.İşkencenin önlenmesi konusunda, temel bir rehber konumunda olan İstanbul Protokolü, ülkemizde yaşanan işkence ihlallerinin önlenmesinde de büyük katkılar sağlayacaktır. Çalışma yapılırken, yürürlükte bulunan mevzuatımız incelenerek İstanbul Protokolü ile uyumlu ve uyumsuz olan hükümler belirlenmeye çalışılmıştır. Çalışma sonucunda, yasalardan ve uygulamadan kaynaklanan eksiklikler tespit edilerek çözüm önerilerine yer verilmeye çalışılmıştır.

Istanbul Protocol Regarding Documentation of Torture?, Master Thesis, Ankara, 2007Torture, having been used as a penalising method or evidentiary tool at the beginning, has become the subject-matter of many international documents as an absolute law during the historical process. However, existence of torture prohibition within the international documents and national legislation could not suffice to prevent torture events in practice.Difficulty and importance concerning prevention of torture breaches compelled international authorities and institutions to work together. One of the documents developed out of such studies is the so-called Istanbul Protocol.In this study, which puts Istanbul Protocol to the center; historical process, the principles to be considered during investigation of torture, documentation of torture in the light of medical evidences, investigation of torture in legal terms are dealt with. In this regard, international documents are examined and decisions of European Court of Human Rights are touched upon.Istanbul Protocol, being an essential guide in respect of prevention of torture, would make great contributions towards prevention of tortures in our country. In the study, applicable Turkish legislation being examined, inconsistent provisions with the so-called Istanbul Protocol are striven to be determined. In the conclusion of the study, solution proposals are endeavoured to be given in the light of the shortcoming points determined.
