92 VIII. SUMMARY Crime scene investigation is the beginning point for the successful use of physical evidence by the forensic laboratory and the criminal investigator. Physical evidence encompasses any and all objects that can establish that a crime has been committed or can provide a link between a crime and its victim or a crime and its perpetrator. A subgroup of physical evidence is biological evidence. All biological evidence such as blood, bone, hair, tissue, semen contain DNA and are analyzed using DNA technology. In forensic sciences the most acceptable scientific technique is analyzing the short tandem repeats (STRs) on DNA. When a certain number of STR loci is analyzed and evaluated, it's possible to discriminate the population in a high degree. In this study we aimed to analyze the problematic biological samples that were obtained from crime scenes or taken to the laboratory for paternity testing using the present day technology capillary electrophoresis, to reveal and minimize the problems before, during and after the analysis and to evaluate the results in the view of forensic sciences. It's possible to have some problems in biological samples. The crime scene, the structure of the material and the techniques used are the main causes of these problems. If the investigator cannot recognize biological evidence or cannot properly preserve it for laboratory examination, no amount of sophisticated laboratory instrument or technical expertise can salvage the situation. It means that forensic science begins at the crime scene and to minimize these problems all cautions should be taken from crime scene to evaluation.91 edilmesi, bu analiz sırasında, hatta öncesi ve sonrasında çıkan sorunların ortaya konulması ve giderilmesi için öneriler sunularak adli bilimler açısından değerlendirilmesidir. Çalışmada materyal olarak İstanbul Üniversitesi Adli Tıp Enstitûsü'ne başvuran 7 farklı olgunun iskelet kalıntılarından kemik örnekleri, sigara izmaritindeki tükürük lekeleri, kondomdaki semen lekeleri ile epitel hücreleri, yanak içinden alman sürüntülerdeki tükürük lekeleri ve meme dokusu kullanılarak DNA analizi yapılmış ve sonuçlar değerlendirilmiştir. Çalışmalar sırasında, örneğin olay yerinden alınması, paketlenmesi, korunması ve laboratuvara ulaştırılması sırasında ve laboratuvarda yapılan çekitleme, PCR, elektroforez gibi aşamalarda bir ya da birçok kez sorunlarla karşılaşılmıştır. Bu sorunlar; örneğin yapısından, örneğin olay yerinden toplanması ve paketlenmesi sırasında yapılan yanlışlıklardan, analiz sırasında meydana gelen farklılıklardan kaynaklanmış, bir aşamada yapılan hata, zincir şeklinde bir sonraki aşamaları da etkilemiş ve hem örnek, hem malzeme, hem de zaman kaybına sebep olmuştur. Adli bilimlerde, bu hataların en aza indirgenerek çalışmanın verimli bir şekilde tamamlanması, kesin, doğru, güvenilir ve net bir rapor verilebilmesi için; etkisi en az olan faktörden, en fazla olan faktöre kadar geniş bir çerçevede düşünerek, her aşamada gereken tüm önlemlerin alınması gerektiği anlaşılmıştır. Ayrıca DNA'mn konvansiyonel sistemlere göre daha güvenilir olduğu, hatta DNA üzerinde daha önceden çalışılan bölgelerin identifîkasyonda yetersiz kaldığı bir kez daha görülmüş, STR sistemlerinin önemi ve adli bilimlerdeki ayırım gücü ortaya konulmuştur.
