Özet
ÖZET Bu tez çalışmasında günümüzde ve gelecekte çok önemli bir sorun olabileceği değerlendirilen“çocuk suçlarında soruşturma”konusu incelenmiştir. Çocuk kavramı ve çocuklara ilişkin genel bilgiler ile çocuğun genel olarak gelişim evreleri ve buna ilişkin özellikler açıklanmış; bu alanda çalışacak araştırmacılar ile çocuk suçlarıyla mücadelede görev alacak kolluk görevlilerine yararlı olacak şekilde ayrıntılı bilgiler verilmiştir. Ülkemizde giderek artmakta olan çocuk suçluluğunu daha iyi kavramak maksadıyla çocuk suçluluğu kapsamında; çocukları suça iten faktörler, suçlu çocukların özellikleri ve çocuklar tarafından işlenen suç türleri açıklanmıştır. Çocukların korunması ve özel bir statüye sahip olmaları gerçeğinden hareketle, çocuk haklarına ilişkin ulusal ve uluslar arası düzenlemelere değinilmiş, ülkemizde çocukları koruma hizmetleri kapsamında yürütülen faaliyetler açıklanmıştır. Tez çalışmasının diğer önemli kısmında ceza muhakemesinde soruşturma kavramı, çocukların cezaî sorumlulukları ve çocuklarla ilgili özel düzenlemeler açıklanmış ve çocuk suçluluğuyla mücadelede kolluğun yeri ve önemi üzerinde durulmuştur. Mevcut durumda polisin ve jandarmanın çocuk kolluğu olarak yürüttüğü faaliyetler ile, bu faaliyetlerin yasal dayanakları ve yapılan işlemler ve karşılaşılan sorunlara genel olarak değinilmiş ve çözüm önerileri belirtilmiştir. Son olarak, çocuk suçluluğunun toplumun tüm kesimini ilgilendiren bir konu olduğu tespiti ve genel bir değerlendirmesi ile bu alanda kurum ve kuruluşlara düşen görevler üzerinde durulmuş; kolluğun yapılanması ve bununla ilgili mevzuat kaynaklarına değinilmiş ve AB'ye uyum kapsamında mevzuatta yapılması gereken değişiklikler açıklanmıştır. ABSTRACT This study explores the“issue of criminal investigation of juvenile delinquency”which is one of the most critical issues in the realm of criminal justice not only for today but also for future. The subject of juveniles and related issues are defined along with the characteristic futures and developmental stages of juveniles. Furthermore, a detailed explanation of juvenile delinquency was given for the law enforcement agencies and investigators dealing with these issues. In order to understand the real reasons behind the fact that juvenile delinquency has been increasing in our society, this study tries to explain the factors which encourage juveniles to commit crime, the types of crimes which are more commonly committed by juveniles who commit these kinds of crimes. Because it is widely accepted that the juveniles should have a special position in justice system, and protection of juveniles in our society is an important issue; this study not only gives information about what our nation and justice system have been doing in order to protect juveniles, but also shows us the international regulations on juvenile delinquency. Another important aspect of this study is to explain the terms of criminal investigations of juvenile delinquency and of punishment responsibility of juvenile.The special regulations on juvenile delinquency and the role, of law enforcement agencies on this issue are the other two main parts of this study. This study gives information about the activities of the law enforcement agencies on juvenile delinquency, the legal sources of these activities, and the general problems which these law enforcement agencies face during these activities. This study also proposes solutions to the problems. Finally, this study concludes that juvenile delinquency is an important issue for the whole society. This study proposes what the governmental agencies should do about this issue. This also explains how the law enforcements change their organic structures made in our laws and regulations in order to complete the process to be a member of the European Union. vn
