Özet
oz“Telekomünikasyon sektöründe rekabet koşullarının iyileştirilmesi için, Türkiye'nin mevcut hukuki düzeninde eksiklikler ve sorunlar bulunmaktadır”şeklindeki hipotez,“Telekomünikasyon Sektöründe Rekabet Koşullarının İyileştirilmesi-Hukuksal Yaklaşım”başlıklı çalışmanın konusunu oluşturmaktadır. Çalışmanın hazırlanmasında çok sayıda yerli ve yabancı kaynaktan yararlanılmıştır. Avrupa Birliği ve yabancı ülkelerdeki telekomünikasyon sektöründeki gelişmeler, kurumsal yapılanmalar ile bu sektörde rekabet koşullarının iyileştirilmesi için geliştirilen politikalar, hukuki yöntemler ve düzenlemeler incelenmiştir. Öte yandan Türk telekomünikasyon sektöründeki gelişmeler, Türk telekomünikasyon ve rekabet mevzuatı ile uygulamaları irdelenerek hipotez, test edilmiştir. Elde edilen tüm bilgilere dayanılarak, tez konusu ile ilgili sonuçlara ve Türkiye'de telekomünikasyon sektöründe rekabet koşullarının iyileştirilmesi için hukuki açıdan neler yapılması gerektiğine ilişkin önerilere, çalışmanın“sonuç”bölümünde yer verilmiştir ABSTRACT The hypothesis that“There are shortcomings and problems in the current legal order of Turkey with regards to the improvement of the competitive environment in the telecommunications sector”constitutes the subject of this study titled“Enhancement of the Competitive Environment in the Telecommunication Sector - A Legal Approach”. Several domestic and international resources were utilised in the preparation phase. The developments, organizational structures, and policies devised to enhance the competitive environment, legal methods and legislative order in the telecommunication sector in the European Union and foreign countries have been examined. On the other hand, the developments in the Turkish telecommunication sector, the Turkish legislation related to telecommunication and competition as well as implementation thereof have been analysed to test the hypothesis. Based on all the information obtained, the conclusions related to the subject of the thesis and some suggestions on what needs to be done legally to enhance the competitive environment in the telecommunication sector in Turkey are provided in the Results section of the study.
