Özet
Türkiye, Aralık 1999'da, Avrupa Birliği (AB)'ne aday ülke olarak kabul edilmiş ve akabinde tüm sektörlerde AB'ye uyum süreci başlatılmıştır. Bu uyum sürecinden; yatırım projelerinin temelini oluşturan ve insan-toprak ilişkilerini düzenleyen tapu-kadastro sektörünün de etkilenmesi kaçınılmazdır. Bu noktada, bu etkilenmenin ne şekilde ve hangi boyutta olacağı sorusu gündeme gelmiştir. Bu çalışmada; AB bünyesinde kadastral sistem bazında bir birliğin olup olmadığının ve AB ülkelerindeki kadastral sistemlerin araştırılması amaçlanmıştır. Ayrıca, bu bilgilerin ışığında, AB'ye uyum sürecinde, Türkiye kadastral sisteminde izlenmesi gereken politikanın belirlenmesi hedeflenmiştir. Bu amacı gerçekleştirmek üzere; öncelikle Topluluk Müktesebatı ve AB bünyesindeki konuyla ilgili faaliyetler incelenerek, AB 'de kadastral sistem anlayışı belirlenmiştir. Sonraki aşamada, AB üye ülkelerinin kadastral sistemleri kendi içinde ve Türkiye kadastral sistemi ile karşılaştırılmıştır. Karşılaştırma sonucu, AB Kadastro Deklarasyonu açısından irdelenerek, Türkiye'nin, tapu ve kadastro alanında izlemesi gereken yol belirlenmeye çalışılmıştır. Çalışmanın sonucunda, AB üyesi ülkelerin sistemlerinin, özellikle temel prensipler ve teknik ölçütler başta olmak üzere, bazı ölçütler bağlamında örtüştüğü, bazı ölçütler bağlamında ise önemli farklılıkların olduğu belirlenmiştir. Yani, birlik bünyesinde, kadastral anlamda standardizasyonun mevcut olmadığı görülmüştür. Öte yandan, Türkiye kadastral sisteminin, teorik anlamda AB üyesi ülkelerle aynı platformda iken, ülkenin coğrafi ve ekonomik yapısı dolayısıyla, uygulamada, bazı Birlik ülkelerinin eriştiği noktaya henüz gelmediği görülmüştür. Bu durumda, Türkiye kadastral sisteminin, AB Kadastro Deklarasyonu ve çağın yönelimleri dikkate alınarak iyileştirilmesi gerekmektedir. Bu iyileştirme, Türkiye kadastral sistemini, hem AB düzeyine eriştirme hem de modern kadastro hedeflerine yönlendirme açısından büyük önem taşımaktadır.

The Analysis of Cadastral System in the European Union Countries and the Evolution of Turkey Cadastral System in the Adaptation Process. Turkey was accepted as a candidate country to the EU in December 1999 and subsequently the adaptation process to the EU in all sectors was started. It is inevitable that this adaptation process also affects the land registry and cadastre sector constructing the base of investment projects and arranging human-land relationship. At this point, the question of what the form and the dimension of this effect will be put on the agenda. The purpose of this study is to investigate if there is any unity in cadastral system in the scope of the EU and cadastral systems of the EU member countries, and to determine the policy that the Turkish cadastral system needs to follow during adaptation to the EU. To fulfill this aim, firstly, the concept of cadastral system in the EU has been determined by examining the related activities and the Acquis Communautaire. Secondly, the cadastral systems of the EU member countries have been compared with each other and with Turkish cadastral system. By studying the comparison results from the Declaration of the Cadastre in the EU stand point; the necessary policy to be followed by Turkey was determined. As a result, the study has concluded that the EU countries have important differences in several criteria concerning cadastral systems, while they have a lot in common in basic principles and technique criteria. Namely, it has been seen that there is no standardization in cadastral sense. On the other hand, it has been seen that while the Turkish cadastral system is theoretically similar to that of the EU countries, it has not reached the level of some union countries, because of its geographic and economic structure. In this case, Turkish cadastral system should be improved by taking the Declaration and technological developments into consideration. This development is of crucial importance for both carrying Turkish cadastral system to level of the EU member countries and orientating it towards modern cadastre.
