V ÖZET YÜKSEK LİSANS TEZİ AVRUPA İNSAN HAKLARI MAHKEMESİ KARARLARI ÇERÇEVESİNDE KOLLUKTA OLMASI GEREKEN OLAY YERİ İNCELEMESİ ZiyaettinKAYGUSUZ Danışman: Yrd. Doç. Dr. Yusuf BÜYÜKAY Bu çalışma, Avrupa Birliğine girme sürecindeki ülkemizin, insan haklan ve hukuk devleti ilkelerine uygun olarak yapılması gereken“olay yeri incelemesinin”tespit edilmesi; bu amaçla, ülkemiz aleyhine birçok kararlar verilen ve yüksek miktarlarda tazminat ödememize sebep olan AİHM kararlarında olay yeri incelemesi ile ilgili belirlenen kriterler ışığında, ülkemizde yapılan olay yeri inceleme çalışmaları irdelenerek, tespit edilen eksiklik ve hatalar ortaya konmaya çalışılmıştır. Olay yeri inceleme işlenüerinin değerlendirildiği 2000-2004 yıllan arasında, Türkiye ile ilgili verilen kararlardan toplam yedi AİHM karan ele alınarak incelenmiştir. Aynca, Türkiye'deki teknik hizmetlerin nasıl yürütüldüğü ve yapılan işlemlerle ilgili genel bir değerlendirme yapılmıştır. Ceza yargılamasında, soruşturmanın tam ve eksiksiz yapılabilmesi için olay yeri inceleme işlemlerinden olan kimlik tespit ve delillerin usulüne uygun toplanmasının önemi ve usulleri üzerinde durulmuştur. Daha sonra, tespit edilen AİHS Mallerinin tekrarlanmaması için, olayın meydana gelmesinden sonuçlanana kadar AİHM kararlan çerçevesinde olması gereken olay yeri mcelemesinin, nasıl ve ne şekilde olması gerektiği çözüm önerileri ile açıklanmıştır. Bu çalışmada, olay yeri inceleme işlemleri nitelik ve kapsam itibariyle bir bütün olarak ele alınmış, her olayla ilgili yapılması gereken teknik işlemler üzerinde durulmamıştır.

Prof. Dr. Yusuf BÜYÜKAY This study, for determining 'The crime scene investigation' that should be proper with the human rights and law otority criterias in our country that is about to adaptate with European Union; by this purpose, the crime scene investigation in our country had been examined and the deficiencies and mistakes had been tried to put forward, according to the criterias that had been determined about the crime scene investigation which had been resulted by the European Court of Human Rights judgements against our country and high amounts of compensations The significance and the procedures of identification and proper ways of evidence collection which are the main parts of crime scene investigation are explained in this study in order to manage the prosecutions and the criminal trials. Further, the suggestions for solutions and how the procedures should be tried to be brought up about the crime scene investigation involving the incident -at the begining till the end- that should be appropirate with the resolutions of The European Court of Human Rights in order to prevent the recurrence of violations of The European Convention of Human Rights that had been detected. In this study, the crime scene investigation had been taken up by the angle of all characteristic and coverage, but the technical process had not been mentioned that should be done about each incident.
