Özet
ÖZET Sosyal Hukuk devleti vatandaşlarının sosyal güvenliğini sağlamakla yükümlü devlet demektir. Anayasa'nın 2. maddesi Türkiye Cumhuriyeti Devletinin bir sosyal hukuk devleti olduğunu,- 60 maddesi de herkesin sosyal güvenlik hakkına sahip olduğunu, devletin bu hakkın gereklerini yerine getirmek için gerekli tedbirleri alacağını ve gerekli teşkilatı kuracağını belirtir. Devlet Anayasa'nın 60. maddesi gereğince bağımlı çalışanların sosyal güvenliğini sağlamak üzere 1945 tarih ve 4792 sayılı Kanun ile İşçi Sigortaları Kurumunu kurmuştur. Kurumun adı daha sonra 506 sayılı Kanun ile Sosyal Sigortalar Kurumu olarak değiştirilmiştir. Sosyal güvenlik sisteminde yeniden yapılanma çalışmaları çerçevesinde 616 sayılı KHK. ile Kurumda yeni bir yapılanmaya gidilmiş ve Kurumun o zamana kadarki örgütsel yapısı yeniden şekillendirilmiştir. Birinci bölümde sosyal devlet ve sosyal güvenlik kavramlarını tarihsel gelişimleriyle birlikte inceleyip sosyal güvenliği sağlamaya yönelik tekniklere değindikten sonra SSK'nın sosyal sigorta esaslarına göre sosyal güvenlik hizmeti sağlayan bir kamu kurumu olduğu tespit edilmiştir. İkinci bölümde Kurumun hukuki, idari (organik yapısı ve birimleri) ve mali yapısını yeni düzenlemeler ışığında ele alıp bu düzenlemelerle öngörülen yeni yapılanma modeli, Kurumun Türk idari teşkilatındaki yeri, merkezi idareyle olan ilişkileri ve idari ve mali özerkliği konuları ele alınmıştır. Üçüncü bölümde ise Kurumun amacı ve görevleri incelenmiştir. Bu çerçevede öncelikle Kurumun ilgili sosyal sigorta kanunları kapsamında kalan sigortalılara sağladığı sosyal güvenlik yardımları ve Kurumun diğer işlevleri belirtilmiş sonra da Kurumun işlem ve faaliyetleri ile ilgili olarak yapılan denetim faaliyetleri ve bu denetimleri gerçekleştiren denetim organları incelenmiştir.

ABSTRACT The social state has to provide the social security of it's citizens. According to the article 2 of the Constitution, the Turkish Republic State is a social state and according to the article 60 everybody has the right of social security and the state has to take the precautions which are necessary to provide the social security and to establish the social security establishments. The state has established the Laborer Insurance Association by the bill number 4792 to provide the social security of laborers as it is indicated at the article 60 of Constitution. The name of the Association is later changed as Social Insurance Association (SIA) by the bill number 506. Some important arrangements have been made in order to reform the social security system. The organic stucture of the SIA is reformed by these arrangements and the Association is organized as a presidency. In the first section of the study we studied“social state”and“social security”terms with their historical development. Then we talked about the technics which are used to provide the social security like social insurance and we indicated that the Social Insurance Association is an establishment which furnishes the social security service according to the social insurance technic. In the second section we studied the legal, administrative (organic structure) and fiscal structure of the Association by the help of changes made by new arrangements. Then we indicated tie location of Social Insurance Association in the Turkish Administrative System and talked about the managerial and fiscal autonomic of the Association. In the third part we firstly explained the aims and duties of Social Insurance Association and then mentioned the control mechanism about the Association's activities.
