oz KUZEY KIBRIS TÜRK CUMHURİYETİ'NDE OMBUDSMAN DENETİMİ Tamer Gazioğlu Doktora, Siyasal Bilimler ve Kamu Yönetimi Bölümü Tez Yöneticisi: Prof. Dr. Şinasi Aksoy Şubat 2003, 297 sayfa Ombudsmanlık kurumunun temel amacı, vatandaşlar adına, kamu yönetimindeki uygulamaların yasal veya hakça olup olmadığını kontrol etmektir. Özellikle İkinci Dünya Savaşı'ndan sonra yüzden fazla ülke bu kurumu kendi kamu yönetimlerinin denetim sistemlerine dahil etmişlerdir. Ancak bir ülkede Ombudsmanlık kurumunun bulunması, sistemin etkin ve verimli çalıştığı ve vatandaşa gerekli hizmeti vermekte olduğu anlamına gelmez. Ombudsmamn etkin ve verimli çalışmasını, vatandaşlara ve kamun yönetimine gerekli olumlu katkıyı yapmasım doğrudan ve dolaylı olarak etkileyen belirli etkenler vardır. Ombudsmanlık kurumu 1997 yılından bu yana KKTC'nde görev yapmakta ve vatandaşa hizmet etmeye çalışmaktadır. Bu tez çalışması, yasalarla ilgili olan ve olmayan çeşitli etkenleri analiz ederek sistemin verimli çalışmadığım saptamış ve kamu yönetiminin yargı dışı denetlemesini yapan bu kurumun vatandaşın çağdaş beklentilerini karşılamak için etkin çalışmasını sağlamaya yönelik yasal değişiklikleri ve alınması gereken önlemleri önermiştir.

ABSTRACT OMBUDSMAN CONTROL IN THE TURKISH REPUBLIC OF NORTHERN CYPRUS Tamer Gazioğlu Ph.D., Department of Political Sciences and Public Administration Supervisor: Prof. Dr. Şinasi Aksoy February 2003, 297 pages The main objective of the Ombudsman institution, mainly on behalf of the citizens, is to control the actions of the public administration according to their legality and fairness. Mainly after the Second World War more than hundred countries introduced the institution to their administrative control systems. However, having an Ombudsman Institution in a country does not necessarily mean that the system functions properly and provides all kinds of contributions and benefits expected from it. There are some factors, which directly or indirectly influence the effectiveness of the Ombudsman Institution and the level of contribution it makes to citizens and public administration. Since the beginning of 1997 the Ombudsman of the Turkish Republic of Northern Cyprus has been functioning and trying to provide service to the citizens. This study analyzed the effectiveness of the Ombudsman system in the TRNC by utilizing various statutory and non-statutory factors; verified that the system is not functioning effectively; and recommended some statutory modifications to be made and non-statutory actions to be taken. These actions and modifications are deemed necessary in order to make this non-judiciary administrative control system to function effectively and properly in order to meet the contemporary expectations of the citizens.
